ORDER:

This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief/s:-

“… to issue the any appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of respondent No.3 in considering the stay petition in appeal No.F1/2617/2025 till the disposal of appeal as illegal, arbitrary, contrary to the settled principles of law and violative of Articles 14, 19 and 21 of the Constitution of India and consequently direct the respondent No.3 to dispose the stay petition in Inam Appeal No.F1/2617/2025 filed against the order passed by the Respondent No.4 in proceedings No.J/259/2025 dated 15-07-2025 in respect of land bearing Sy.Nos.168 and 182 admeasuring Ac.2-20 gts, Sy.No.168 and 182 admeasuring Ac.2-20 gts, situated at Pendyal Village, Maheshwaram Mandal, Ranga Reddy District and pass such other order or orders…”

Learned counsel for the petitioner Nos.1, 2 and 4 submits that aggrieved by the order dated 15.07.2025 passed by respondent No.4/Revenue Divisional Officer, Kandukur Division, Ranga Reddy District in proceeding No.J/259/2025, the petitioners herein have filed an Appeal vide Inam Appeal No.F1/2617/2025 before respondent No.3/The Additional District Collector, Ranga Reddy District, at Kongarakalan along with stay petition; that despite stay petition, respondent No.5 has issued endorsement No.B/338/2025 dated Nil.09.2025 stating that “without stay orders, this Office cannot stop the mutation process if the slot is booked online portal. Mutation process can be stopped only if there is any stay order issued by competent authority/civil court and survey numbers needs to be looked”. Later, the Appeal was adjourned to 14.08.2025, 23.08.2025, 20.09.2025 and 25.10.2025. Therefore, expressing the urgency involved, the petitioners filed the present Writ Petition and seeks stay of impugned proceedings.

4. Learned counsel for unofficial respondent Nos.6 to 9 contends that the Appeal is not yet admitted; that unless the Appeal is admitted, the question of granting stay of impugned proceedings does not arise. Therefore, he seeks to dismiss the Writ Petition.

5. Learned Assistant Government Pleader for Revenue contends that no notice has been served upon official respondents till date.

6. When the matter is taken up at forenoon, learned counsel for petitioner No.3, by filing the letter addressed to the Registrar (Judicial), High Court of Judicature for the State of Telangana, sought permission of this Court to withdraw the Writ Petition.

Having regard to the submissions of all the learned counsel, on perusing the material available on record and upon considering the fact that the Appeal vide Inam Appeal No.F1/2617/2025 is pending consideration before respondent No.3, this Court without making any observations on the merits or demerits of the case, deems it appropriate to direct petitioner Nos.1, 2 and 4 to file an application seeking to expedite hearing before respondent No.3 expressing urgency for grant of stay in the said Appeal, within four (4) weeks from the date of receipt of a copy of the order. Upon filing the said application, respondent No.3 is directed to pass appropriate orders, as expeditiously as possible, strictly in accordance with law, by putting the interested parties on notice and affording them sufficient opportunity of hearing. Till passing of the orders by respondent No.3, the parties to this Writ Petition are directed to maintain status quo obtaining as on today.
