ORDER:

The instant writ petition is filed declaring the action of the respondents in interfering with the functioning of the towers erected within the limits of 3rd respondent for non-payment of the amount of Rs.40,000/- as permit fee and scrutiny fee of Rs.10,000/-, without issuing any prior notice and without giving opportunity to the petitioner-company, as being arbitrary, illegal, without jurisdiction and in violation of well settled principles of natural justice.

2. When the matter is taken up for hearing, learned counsel for petitioners would submit that in a similar circumstances, this Hon’ble Court in W.P.No.38905 of 2013 and batch, dated 20.12.2016, and also in W.P.No.12314 of 2009 and batch, dated 02.01.2013, directed the respondents therein to regulate the activity of the Cell Towers erected by the petitioner-companies in accordance with the Government orders issued from time to time, but shall not demand any amount towards permit fee as no Government order exists in respect of those cell towers already erected as on 01.08.2013 prior to issuance of G.O.Ms.No.380 dated 01.08.2013.

3. Mr. S.R.Vishnu Murthy, learned counsel representing Mr. Putta Krishna Reddy, learned Standing Counsel for Municipalities, does not oppose the said contention of the learned counsel for petitioners.

4. In view of the same, the instant Writ Petition is also disposed of in terms of the order passed by this Hon’ble Court in W.P.No.38905 of 2013 and batch dated 20.12.2016 and also in W.P.No.12314 of 2009 and batch, dated 02.01.2013. There shall be no order as to costs.

Pending miscellaneous applications if any shall stand closed.
