O R D E R:

This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief/s:-

“… be Issue a Writ of Mandamus declaring the action of the Respondents in rejecting the Petitioner’s request for issuance of the Death Certificate of late Smt.Kadingela Balamani, who died on 24-08-2022, as illegal and arbitrary; and direct the Respondents to consider the Petitioner’s representation afresh and to register the death of late Smt. Kadingela Balamani and issue the Death Certificate in accordance with the Registration of Births and Deaths Act, 1969 and Rules framed thereunder, within a time frame fixed by this Hon’ble Court;

Pending disposal of the above WP, this Hon’ble Court may be pleased to direct the Respondents to accept the Petitioner’s Afresh application for issuance of the Death Certificate of late Smt. Kadingela Balamani, who died on 24-08-2002, which was earlier rejected by the Respondents in vide Transaction ID TTLRBDO22502165765 dated 11-02-2025 and process the same, subject to final orders., in the interest of justice”

2. Heard Mr.Srinivas Byagiri, learned counsel for the petitioner and Mr.L.Ravinder, learned Assistant Government Pleader representing learned Government Pleader for Revenue appearing for respondents.

3. Learned counsel for the petitioner submits that the petitioner’s wife namely Smt. Kadingela Balamani died on 24-08-2002 at their residence. Therefore, the petitioner submitted an application vide Transaction ID TTLRBDO2250216 5765 dated 11.02.2025 before respondent No.2 seeking Death Certificate of Late Smt.Kadingela Balamani. The application filed by the petitioner was rejected vide Endorsement No.K/RTI/18- 343/2025 dated 22.08.2025 by stating that the “Date of Death is above twenty (20) years”. He states that rejecting the request of the petitioner, without causing any enquiry is illegal. He further states that the petitioner had filed a fresh representation for the same relief and seeks a direction to respondent No.2 to pass appropriate orders.

Learned Assistant Government Pleader for Revenue contends that the petitioner ought to have filed relevant documents along with the application, to enable them to cause an enquiry for issuance of death certificate. He states that the petitioner has got every opportunity to approach the competent authority for the said relief. Therefore, he seeks to dismiss the Writ Petition.

Having regard to the submissions of both the learned counsel and on perusal of the material available on record, this Court without making any observations on the merits or demerits of the case, deems it appropriate to direct respondent No.2 to issue notice to the petitioner and the concerned persons and verify the documents filed by them. Upon affording the opportunity of hearing and examining the documents filed by the petitioner, respondent No.2 is directed to pass appropriate orders, as expeditiously as possible, strictly in accordance with law.

6. With the above direction, this Writ Petition is disposed of.

No costs.

Miscellaneous Petitions, pending if any, shall stand closed.
