IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
THE HONOURABLE SMT JUSTICE K. SUJANA
Kallu Nikhil Kumar Reddy – Appellant
Versus
The State of Telangana – Respondent
CRLP 12836/2025

ORDER:

This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioner, who is alleged to be a suspect in an unregistered crime.

2. Heard Sri P.Achut Rama Shastry, the learned counsel appearing on behalf of the petitioner and Sri E.Ganesh, the learned Assistant Public Prosecutor appearing for the respondent-State.

3. Learned counsel for the petitioner submitted that the petitioner was earlier arrayed as an accused in FIR No. 36 of 2025, registered for the offences punishable under Sections 318(4), 316(2) read with 3(5) of the Bharatiya Nyaya Sanhita (BNS). He further submitted that despite the issuance of a notice under Section 35(3) BNS, the de-facto complainant has been attempting to lodge further complaints against the petitioner with an intent to harass him. Therefore, he prayed that this Court be pleased to grant pre-arrest bail by allowing the Criminal Petition.

4. On the other hand, the learned Assistant Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that no report or complaint has been formally registered, and no FIR exists against the petitioner at present. Hence, in the absence of any registered FIR, he prayed that the Criminal Petition be dismissed as premature and not maintainable.

5. Upon careful consideration of the submissions made by both parties and on a perusal of the material available on record, this Court is of the opinion that there exists no sufficient ground to grant pre-arrest bail to the petitioner at this stage, particularly in view of the fact that no FIR has been registered against him.

6. Accordingly, this Criminal Petition is dismissed.

Miscellaneous applications, if any pending, shall stand closed.
