THE HON’BLE SRI JUSTICE PULLA KARTHIK WRIT PETITION No.30649 OF 2025

O R D E R:

With the consent of both the parties, this Writ Petition is taken up for disposal at the admissions stage itself.

2. This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:

“...to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus or any other appropriate writ declaring the action of the Respondent No. 2 in not allowing the petitioner to apply for the post of Assistant Public Prosecutors in Telangana State prosecution Service in pursuant to Notification issued by respondent No. 2 vide Rc No. 234/ Rect. / Admn-2/2025 dated 15.08.2025 despite petitioner fulfilling the eligibility criteria as prescribed in para 11 of the Notification dated 15.08.2025 as being illegal and arbitrary and consequently direct the Respondent No. 2 to allow the petitioner to apply for the post of Assistant Public Prosecutors in Telangana State prosecution Service in pursuant to Notification issued by respondent No. 2 vide Rc No. 234/ Rect./ Admn-2/2025 dated 15.08.2025 and pass...”

3. Heard Mr.Alluri Divakar Reddy, learned counsel for the petitioner and Sri C.Raja Shekar Reddy, learned Standing Counsel for TSLPRB appearing for respondent No.2 and learned Government Pleader for Home appearing for respondent No.1.

4. Learned counsel for the petitioner submits that the petitioner was enrolled as an Advocate with the Bar Council of Telangana on 29.09.2022, with Enrolment No.TS/1963/2022. Since then, the petitioner has been practicing as an Advocate in the State of Telangana. Further, with the intent to apply for the post of Assistant Public Prosecutor pursuant to the notification vide Rc No.234/Rect./Admn-2/2025 dated 15.08.2025, the petitioner obtained an experience certificate dated 07.10.2025, issued by the Metropolitan Criminal Courts Bar Association, Hyderabad, certifying that the petitioner has completed three years of service as an Advocate. However, the respondents are not accepting the petitioner's application on the ground that she had not completed three years of service as on the date of the notification, i.e., 15.08.2025. Therefore, she made a representation to the 2nd respondent on 07.10.2025, with a request to allow her to apply for the post of Assistant Public Prosecutor. However, no action has been taken by the 2nd respondent so far. Therefore, learned counsel prays this Court to direct respondent No.2 to consider the representation, dated 07.08.2025, submitted by the petitioner and pass appropriate orders, as expeditiously as possible.

Learned Standing Counsel appearing for respondent No.2 submits that, as per the notification, a candidate must have completed not less than three years of service as on the date of the notification, i.e., 15.08.2025. However, the respondent No.2 will consider the petitioner’s representation dated 07.10.2025 and pass appropriate orders in accordance with law

Having regard to the submissions made by learned counsel for the respective parties and without expressing any opinion on merits, this Writ Petition is disposed of with a direction to respondent No.2 to consider the representation, dated 07.10.2025, submitted by the petitioner, and pass appropriate orders, strictly in accordance with law, as expeditiously as possible.

Miscellaneous petitions pending, if any, shall stand closed.

There shall be no order as to costs.
