ORDER

This Writ Petition has been filed seeking the following relief:

“…to issue Writ, Order or Direction, more particularly one in the nature of a Writ of Mandamus, declaring the action of the Respondents in not issuing permission to the Petitioner to discharge the lawful religious duties of Petitioner as Sajjadah of Khanqah-e-Nooria i.e., on 03.10.2025 corresponding to 10th Rabi-Ul-Saani 1448 Hijri after Namaz-e-Maghrib prayer 07:00 PM to 09:00 PM Burdah Shareef scheduled to be conducted and from 09:00 PM to 02:00 AM Jalsa Faizaan-e-Ghouse Aazam, Dargah Shareef Noori Shah, Bandlaguda, Hyderabad, Next day on 04.10.2025 corresponding to 11th Rabi-Us-Saani 1448 Hijri, morning after Namaz-e- Fajr, Ziyarat-e-Aassaar-e-Mubarak at Masjid-e-Noori Khanqaahe Nooriya, Noori Maskan, Bandlaguda, Hyderabad and on 07.10.2025 corresponding to 14th Rabi-US-Saani 1448 Hijri, after Namaz-e-Maghrib from 07:00 PM to 09:00 PM Burdah Shareef, from 09:00 PM to 02:00 AM Jalsa Faizan-e- Noori at Dargah Shareef Noori Shah, Bandlaguda, Hyderabad Next day on 08.10.2025 corresponding to 15th Rabi Us-Saani 1448 Hijri morning after Namaz-e-Fajr Sandal Shareef from 07:00 AM to 09:00 AM from Khaiqaahe Nooriya to Dargah Shareef Noori Shah, Bandlaguda, Hyderabad, pursuant to the Petitioner’s representations dated 10.09.2025 as illegal, arbitrary in violation of principles of natural justice and in violation of Articles 14 and 21 of the Constitution of India…”.

Today, when the matter is taken up for hearing, learned counsel on either side have drawn attention of this Court to the order dated 03.09.2025 passed by this Court in W.P.No.24877 of 2025 and submitted to pass similar orders in view of the similarity in the facts and circumstances of the cases. For better understanding of the case, the relevant portion of the said order is extracted as under:

“5. In that view of the matter, since the permission is given to the implead petitioner/respondent No.6 and the writ petitioner vide order dated 02.11.2022 passed by the Telangana State Waqf Tribunal at Hyderabad in I.A.No.841 of 2022 in O.S.No.76 of 2022, petitioner is also permitted to offer prayers as per the above said order and the petitioner shall also confine only to the extent of offering prayers separately without disturbing or creating any law and order problem. Further, it is made clear that since the implead petitioner/respondent No.6 has already been granted permission he shall co-operate in allowing the petitioner to offer the daily prayers. It is also made clear that if there is any deviation in the implementation of the directions of this Court while conducting events at Dargah Hazrath Syed Ahmed Mohiuddin Jeelani AI Maroof Syed Noori Shah Chisthi Qadri (RA) Noori Maskan, Bandlaguda, Hyderabad on 04.09.2025 from 05:00 PM to 10:00 PM – Rouz-e-Nooria, on 04.09.2025 from 03:00 PM to 06:00 PM – Khankha-e-Nooria and on 05.09.2025 from 06:00 AM to 08:00 AM – from Khankhah-e-Nooria to Masjid- e-Noori, by either of the parties, respondent Nos.4 and 5 are directed to take appropriate action strictly in accordance with law.

6. Accordingly, this writ petition is disposed of. There shall be no order as to costs.”

Further, learned counsel for the respondent No.6 has placed a copy of the permission accorded by the Assistant Commissioner of Police, Chandrayangutta Division, Hyderabad on 19.09.2025 to celebrate events at Dargah Hazrath Syed Ahmed Mohiuddin Jeelani AI Maroof Syed Noori Shah Chisthi Qadri (RA) Noori Maskan, Bandlaguda, Hyderabad from 02.10.2025 to 07.10.2025 from 06:00 AM to 10:00 PM with certain conditions.

Learned counsel for the petitioner submits that they have also made an application for the purpose of the same event to The Inspector of Police, Bandlaguda Police Station, Hyderabad, by marking a copy to The Prinicipal Secretary (Home), Government of Telangana, Secretariat, Hyderabad, The Commissioner of Police, Hyder
