THE HON'BLE SRI JUSTICE E.V.VENUGOPAL WRIT PETITION No.27583 of 2022

ORDER :

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

“….to issue an order or direction more particularly one in the nature of writ of mandamus or any other appropriate writ declaring the action of the respondent authorities in not extending the benefits under Rythu Bandhu Scheme to the petitioners to their extents of agricultural lands i.e. admeasuring Ac.0.0375 gts in Sy.No.8A/c/1, Ac.0.0250 gts in Sy.No.255/B/3/1 and Ac.1.35 gts in Sy.No.453/4/A, totaling to an extent of Acs.2.0125 gts of the petitioner No.1 and land admeasuring Acs.5.15 gts in Sy.No.36/A, Ac.1.34 gts in Sy.No.453/1, totaling to Acs.7.09 gts of the petitioner No.2 situated at Bommanapally Village, Chigurumamidi Mandal, Karimnagar District even though they are entitled for the same considering their representations dated 28.05.2022 is nothing but arbitrary illegal null and void and violative of principles of natural justice and also violative of Articles 14 and 21 of the Constitution of India Consequently direct the respondent authorities to consider the representations of the petitioners dated 28.05.2022 and extend the benefits under Rythu Bandhu Scheme for their above shown agricultural lands and to pass.…”

Learned counsel appearing for the petitioners would submit that petitioner No.1 is the absolute owner and possessor of the land admeasuring Ac.0.0375 gts in Sy.No.8A/c/1, Ac.0.0250 gts in Sy.No.255/B/3/1 and Ac.1.35 gts in Sy.No.453/4/A, totaling to an extent of Acs.2.0125 gts, situated at Bommanapally Village, Chigurumamidi Mandal, Karimnagar District. Petitioner No.2 is the brother of petitioner No.1 and also absolute owner and possessor of land admeasuring Acs.5.15 gts in Sy.No.36/A, Ac.1.34 gts in Sy.No.453/1, totaling to an extent of Acs.7.09 gts situated at Bommanapally Village, Chigurumamidi Mandal, Karimnagar District.

Learned counsel further submitted that even though the petitioners are pattadars, owners and possessors of the subject lands and even though they are entitled to the benefits under Rythu Bandhu Scheme, the respondent authorities are not extending the same to the petitioners. The petitioners made representations on 28.05.2022 to respondent No.4. Despite receiving, respondent No.4 has not acted upon the same. Hence, the present writ petition.

Learned Assistant Government Pleader for Revenue, for respondent Nos.1 to 3 would submit that the petitioners without making any application to respondent No.4 have rushed to this Court at a premature stage. The matter is pending before respondent No.4, who is the competent authority. If petitioners make representation to respondent No.4, respondent No.4 will consider the same and pass appropriate orders in accordance with law.

In the light of the above facts and circumstances of the case, this Writ Petition is disposed of, granting liberty to the petitioners to file detailed representation to respondent No.4 within a period of eight (08) weeks from the date of receipt of a copy of this order. On filing such representation, respondent No.4 shall consider the same and pass appropriate orders, strictly in accordance with law within a period of 12 weeks thereon. There shall be no order as to costs.

As a sequel, miscellaneous petitions, if any, pending, shall stand closed.
