THE HONOURABLE SRI JUSTICE B. VIJAYSEN REDDY ORDER : (ORAL)

This writ petition is filed to set aside the revocation order bearing Lr. No. 464785/GHMC/21760/2024 dated 21.04.2025, issued by respondent No.3, as illegal, arbitrary, without jurisdiction, and in violation of the principles of natural justice; and consequently, to direct respondent Nos.1 to 3 to restore the building permission granted to the petitioner under Application No.464785/GHMC/21760/2024 and Permit No.464785/10993/GHMC/2024 dated 21.12.2024, and to ensure that the same is reflected in the TS-bPASS portal/GHMC records forthwith.

2. Heard Mr.M.Vishal Reddy, learned counsel for the petitioner respondents Nos.2 to 4.

3. Learned counsel for the petitioner submits that, in an earlier round of litigation in W.P. No. 20132 of 2025, this Court passed an order dated 11.07.2025, suspending the speaking order dated 07.07.2025 issued by Respondent No. 3, and directed that the seals affixed to the petitioner’s property be removed. In compliance with the said order, the property was unsealed, and possession was restored to the petitioner. However, the petitioner later came to know that the impugned revocation order dated 21.04.2025 had been issued. Learned counsel further submits that the Deputy Commissioner, GHMC — Respondent No. 3 — is not the competent authority to issue a revocation order under Section 450 of the Greater Hyderabad Municipal Corporation Act, 1955, as held by this Court in W.P. No. 2974 of 2025 dated 18.02.2025.

submitted that, in view of the order passed in W.P.No.2974 of

2025, the revocation order is liable to be set aside.

5. In view of the above submissions, the revocation order bearing Lr. No. 464785/GHMC/21760/2024 dated 21.04.2025, issued by respondent No.3, is hereby set aside.

6. Accordingly, the writ petition is allowed. There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
