O R D E R:
With the consent of both the parties, this Writ Petition is being taken up for disposal at the admission stage itself.
2. This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:
“…to issue a writ or order or direction more particularly one in the nature of writ of mandamus declaring that the action of the respondents in not allowing the petitioner into duty is bad, arbitrary, illegal, unjust and unreasonable and consequently direct the respondents to allow the petitioner in to duty as per proceedings No.PA/19(51)/2024-RM:HR, dated 9.8.2024 of the 2nd respondent herein…”
3. Heard Sri P.Venkateshwer Rao, learned counsel for the petitioner; Sri R.Anurag, learned Standing Counsel for Telangana State Road Transport Corporation, appearing for respondent Nos.1 to 4; and learned Government Pleader for Services-I appearing for respondent No.5.
4. Learned counsel for the petitioner submits that the petitioner was engaged as a Contract Driver in the respondent Corporation and his services were regularized in the year 2014. While so, the petitioner could not attend to his duties for (11) days during August and September of the year 2021. However, basing on such a minor charge, he was removed from the service on 08.07.2022. Therefore, the petitioner filed review petition before respondent No.2, on consideration of which, he was reinstated, subject to his medical fitness to the post of Driver in terms of Cir.No.PD- 14/2017, dated 26.05.2017, and the petitioner was directed to report within seven (7) days from the date of receipt of the proceedings, failing which, the order of reinstatement stands cancelled. However, the petitioner could not report to duty within the stipulated time owing to two major incidents; the sudden demise of his daughter; and the falling of a ceiling fan on his wife, which resulted in serious injuries on her stomach. Therefore, learned counsel for the petitioner prays this Court to permit the petitioner to make a representation to respondent No.2 for redressal of his grievance, and also seeks a direction to respondent No.2 to consider the same and pass appropriate orders within the stipulated time.
5. Learned Standing Counsel for respondents submitted that respondent No.2 has reinstated the petitioner into the service vide proceedings No.PA/19(51)/2024-RM:HR, on humanitarian grounds. Despite the same, the petitioner did not report to duty within the stipulated time. However, it is fairly submitted that respondent No.2 will consider the representation of the petitioner, as and when received, and pass appropriate orders, in accordance with law.

Having regard to the submissions made by learned counsel for the respective parties, without going into the merits of the case, this Writ Petition is disposed of permitting the petitioner to make a representation to respondent No.2 within a period of ten (10) days from the date of receipt of copy of this order. On receipt of such representation, respondent No.2 is directed to consider the same and pass appropriate orders thereon, strictly in accordance with law, as expeditiously as possible, within a period of four (04) weeks therefrom and communicate a copy thereof to the petitioner.
Miscellaneous petitions pending, if any, shall stand closed.
There shall be no order as to costs.
