ORDER

Heard the learned counsel for the parties and with their consent this writ petition is disposed of at the threshold.

The petitioner is aggrieved by the action of the respondents in seizing vehicle Tractor No.AP 15 BN 0613 & Trailer No.AP 36 AC 8278 (hereinafter referred to as ‘the subject vehicle’) on 31.07.2025 without following any procedure under statues contemplated under Section 9Q Sub Section 7 of Minor Mineral Concession Rules belonging to the petitioner filed the present writ petition with a consequential prayer to direct the respondents to release the said vehicle.

The learned counsel for the petitioner would submit that the subject vehicle was going on to Tangallapalli to Siricilla on 31.07.2025 with the load of sand for his personal use and the said load is as per the permit and the vehicle is run by the petitioner. The subject vehicle was checked by the respondent No.3, Tahsildar, and seized the same and kept the same at the respondent No.2, District Collector, to the open sky as idle and without following the due procedure as envisaged in G.O. Ms. No.3 dated 08.01.2015 issued by the Industries & Commerce (Mines-I) Department. Challenging the same, petitioner filed the present writ petition.

4. The learned counsel for the petitioner would further submit that in similar circumstances, this Court disposed of the W.P. No.9605 of 2025 on 28.03.2025 with certain directions and this writ petition may also be disposed of in terms of the order dated 28.03. 2025.

5. The learned Assistant Government Pleader appearing for the respondents does not dispute the submissions made by the learned counsel for the petitioner and submitted that the subject vehicle is in the custody of the respondent No.2, District Collector.

6 In that view of the matter, this writ petition is disposed of in terms of the W.P. No.9605 of 2025 dated 28.03.2025 directing the petitioner to approach the respondent No.2, District Collector, by way of submitting a representation along with all original documents in respect of the ownership of the subject vehicle and inform the respondent No.2 that the petitioner is ready to comply with Rule – 12 of the Rules, 2015. On receipt of the said representation, respondent No.2 shall consider the same and dispose it of in terms of Rule – 12 of the Rules, 2015 within a period of two (02) weeks thereafter.

7. Accordingly, this writ petition is disposed of. There shall be no order as to costs.

As a sequel, miscellaneous applications, if any pending, shall stand closed.
