ORDER

The petitioners are aggrieved by the action of respondent No.4 in not providing Police Bandobust to the petitioner for the upcoming URS-e-Shareef procession of Hazrat Syedna Imam Ali Shah Al Hassani Wal Hussainin Al-Quadri (R.A.), Balapur, Hyderabad scheduled from

06.00 PM to 10.00 PM on 21.08.2025.

The facts of the case in brief as stated are that the petitioner’s grandfather Syed Waliullah Hussaini Al-Quadri was the original Waqif of Sajjadah Naheen of Dargah Hazrat Imam Ali Shah and had developed the Dargah and the said Muntakhab was published in Government of Asifjah 1351 Fasli, 12th Rabbi UI Awwal Hijri vide File No.269/2 Auqaaf Section 1350 Fasli. The founder has 7 sons, later the founder died on 23.03.1957 and all the children died subsequently. At present, the petitioner is performing annual Urs ceremonies of Hazrat Syedna Imam Ali Shah Al Hassani Wal Hussainin Al-Quadri (R.A.), Balapur, Hyderabad, whereas the upcoming URS-e-Shareef ceremonies are going to be held on 21.08.2025 from 06.00 PM to 10.00 PM. The petitioner herein has filed application on 07.08.2025 before respondent No.4 with a request to provide necessary Police Bandabust on the occasion of the procession of the above said Urs-e-Shareef vide Application No.15210708551525490008. However, respondent No.4 neither disposed of the above application nor passed any order on the said application on the ground that a case in Cr.No.47 of 2025 is pending against the petitioner on the file of Kanchanbagh Police Station, Hyderabad.

3. The petitioner has filed Crl.P.No.9628 of 2025 before this Court wherein this Court disposed of the said Criminal Petition vide its order dated 31.07.2025. It is submitted that petitioner is performing annual ceremonies and respondent No.4 at an earlier instance i.e., on 17.02.2025, granted permission to perform procession of Urs-e-Shareef with certain conditions. The copy of the proceedings dated 17.02.2025 has been enclosed along with the writ petition.

Per contra, Mr.M.Srinivas, learned Assistant Government Pleader for Home has placed a copy of proceedings issued by Assistant Commissioner of Police, Chandrayangutta Division dated 16.08.2025, wherein permission was granted to one Syed Zainul Abideen Hussaini Quadri (Mob.No.9885093523) for performance of Annual Urs of Syed Sha Imam Shah Al Hassani Wal Hussainin Al-Quadri (R.A.), Balapur Dargah, Hyderabad with certain conditions from 20.08.2025 to 23.08.2025, on his application. Learned Assistant Government Pleader has also placed a copy of proceedings of Chief Executive Officer, Telangana Waqf Board dated 18.12.2022 appointing Syed Zainul Abideen Hussaini Quadri as president of Towliath Committee for a period of 3 years under Section 63 of Waqf Act, 1995, as such the permission for performance of Annual Urs-e-Shareef is granted in his favour.

The main grievance of the petitioner is that while the application of the petitioner dated 07.08.2025 is pending for consideration, respondent authorities have granted permission to one Syed Zainul Abideen Hussain Quadri on 16.08.2025. Learned counsel would reiterate that petitioner was earlier granted permission for performance of Urs-e-Shareef on last few occasions. However, the present application dated 07.08.2025 was neither disposed of nor rejected by the respondent authorities. Learned counsel for the petitioner, on instructions, would submit that petitioner would join in the procession held by Syed Zainul Abideen Hussaini Quadri and would cooperate for the peaceful conduct of the procession and ceremonies.

6. Learned Assistant Government Pleader would submit that petitioner’s application dated 07.08.2025 has been rejected. However, the copy of rejection order has not been filed.

7. In that view of the matter, without going into the merits of the case, this Court deems it appropriate to dispose of the writ petition permitting the petitioner to join the Urs-e-Sha
