ORDER:

(Per the Hon’ble Sri Justice Abhinand Kumar Shavili)

Aggrieved by non-disposal of the petitioner’s application, dated 15.05.2025, seeking for grant of Consent for Establishment and Consent for Operation, the present Writ Petition is filed.

2. Heard Ms. P. Vijaya Lakshmi, learned counsel appearing for the petitioner and Zeeshan Adnan Mahmood, learned Standing Counsel for T.S. Pollution Control Board appearing for respondent Nos.3, 4 & 5.

Learned counsel for the petitioner had contended that the petitioner has obtained a Letter of Intent from the Deputy Director of Mines and Geology on 12.12.2024 for carrying out quarry operations for gravel, building stone, road metal and rough stone over an extent of 2.350 hectares in Sy.No.223/1/2 of Keesara village and Mandal, Medchal-Malkajgiri District. Pursuant to the same, the petitioner has submitted an application before the Telangana State Pollution Control Board on 15.05.2025, seeking Consent for Establishment and Consent for Operation. However, no orders were passed by the Pollution Control Board on the application. Therefore, appropriate orders be passed in the Writ Petition by directing the respondent-Pollution Control Board to consider the application submitted by the petitioner on 15.05.2025 and pass appropriate orders in accordance with law.

4. On the other hand, learned Standing Counsel appearing for the Pollution Control Board had contended that the application of the petitioner was duly considered and while Consent for Establishment was granted, however the Consent for Operation was rejected on

14.07.2025.

This Court, having considered the submissions made by both the parties, is of the view that if the application of the petitioner is rejected, the authorities are bound to pass the reasoned order and communicate the same to the petitioner. Therefore, the Pollution Control Board shall consider the application submitted by the petitioner on 15.05.2025 and pass appropriate orders in accordance with law.

6. With the above observations/directions, the Writ Petition is disposed of. There shall be no order as to costs.

7. As a sequel, miscellaneous applications pending if any, shall stand closed.
