THE HON’BLE SMT. JUSTICE TIRUMALA DEVI EADA CRIMINAL PETITION No.7251 OF 2025

ORDER:

This Criminal Petition is filed by the petitioner – accused seeking to quash the FIR No.184 of 2025 on the file of the P.S.Kukatpally, registered for the offences under Sections 318 (4), 64(1), 69 of Bharatiya Nyaya Sanhita, 2023 (for short “the BNS”)

and Section 3(2)(v)(a) of SC/ST (POA) Act.

2. Heard the submissions of Sri P.V.S.K.Chakravarthy, learned counsel for the petitioner and Smt.Shalini Saxena, learned Assistant Public Prosecutor for respondent No.1 – State.

The learned petitioner counsel has submitted that the petitioner has never abused the de facto complainant in the name of the caste and that he could not marry her as his parents refused to get him married to the respondent No.2 as she belongs to SC. He further submitted that the petitioner is working in air forces and hails from a reputed family and that the allegations leveled against the petitioner are false and created by the de facto complainant, since she bears a grudge against him as he refused to marry her.

4. The learned Assistant Public Prosecutor has submitted that the name of caste and also that 161 Cr.P.C. statements of four witnesses have been recorded by the police and police are yet to collect evidence in this regard. She therefore, prayed to dismiss the petition.

5. Perused the record.

The allegations point out that the petitioner has developed intimacy with respondent No.2 through a common friend and further has entered into a romantic relationship on a proposal of marriage and subsequently refused to marry her saying that his parents could not accept her as she belongs to SC community. It is alleged that the petitioner met respondent No.2 in 2022 and their relationship went on till 2025. The complaint is dated 19.01.2025. The petitioner hails from Yadava Community as pointed out in the complaint and respondent No.2-de facto complainant hails from scheduled caste. Thus, the allegations leveled against the petitioner under Sections under Sections 318 (4), 64(1), 69 of BNS and Section 3(2)(v)(a) of SC/ST (POA) Act, are of serious nature.

statements of four witnesses are recorded by the police and they are yet to collect evidence and complete the investigation. Under the facts and circumstances, this Court is not inclined to interfere with the investigation at this stage.

With the said observations, this petition is disposed of directing the police concerned to conclude the investigation at the earliest, strictly in accordance with law, without taking any coercive steps against the petitioner. Further, the petitioner shall co-operate with the Investigating Officer as and when required for the purpose of investigation.

Miscellaneous applications pending, if any, shall stand closed.
