The petitioner has filed the suit in O.S.NO.283 of 2021 against the Ravela Innaiah and others for perpetual injunction. Learned trial Court has granted exparte temporary injunction dated 23.12.2021 in I.A.No.1499 of 2021. The said order is in subsistence and the said suit is pending. Even then the defendants in the said suit has violated the said order and interfered with the possession of the petitioner over the subject property (suit schedule property). On the complaint lodged by the petitioner, the 2nd respondent had registered a case in Crime No.133 of 2025 dated

05.07.2025 against the defendants in the said suit for the offences punishable under Sections 118(1) of 351(2) of BNS. There are four more crimes. Therefore, the petitioner is seeking police aid from the 2nd respondent.

3. As discussed supra, the order dated 23.12.2021 in I.A.No.1499 of 2021 in O.S.No.283 of 2021 is only an exparte order. If the said exparte order is violated, the petitioner has to approach the very same court by filing an appropriate application seeking police aid and it is for the trial Court to decide the said application.

4. During the course of hearing, it is brought to the notice of this Court that the defendants have already entered appearance in the said suit in O.S.No.283 of 2021. The said Interlocutory Application is also pending.

5. A perusal of the record would reveal that the petitioner has not submitted any representation to the 2nd respondent with a request to provide police aid. The petitioner herein has not made the defendants in O.S.No.283 of 2021 as parties to the present Writ Petition. Therefore, the petitioners herein are not entitled for any relief much less the relief sought in the Writ Petition.

6. In the light of the above, this Writ Petition is liable to be dismissed, and accordingly, dismissed. However, liberty is granted to the petitioner to approach the learned trial Court by filing an appropriate application seeking police aid and it is for the learned trial Court to decide the said application, considering the parameters issued by this Court vide order dated 09.06.2025 in C.R.P.No.2536 of 2024.

As a sequel thereto, the miscellaneous petitions, if any, pending in the Writ Petition shall stand dismissed.
