ORDER:

1. Heard Mr. T.Srikanth Reddy, learned Counsel for the petitioner, Mrs.Sujatha Kurapati, learned Government Pleader for Higher Education, Sri Prabhakar Peri, learned Standing Counsel for the respondent No.2 and Sri R.Sushanth Reddy learned Counsel for the respondent No.3 to 5.

Learned Counsel for the petitioner would submit that the petitioner is questioning the Circular dated 12.06.2025 issued by the respondent No.5 on behalf of the respondent Nos.3 and 4 detaining the petitioner from appearing for Examinations of B.Tech (CSE) – III Year II Semester in the academic years 2024-25 that Lab Examinations were held from 14.06.2025 to 18.06.2025 and written examination from 20.06.2025 to 02.07.2025 consequent to the Notification dated 01.05.2025 issued by the respondent No.4 on behalf of the respondent No.3 in spite of receiving the examination fee on 23.05.2025, without considering the medical certificates and without considering the representations submitted by the petitioner on 10.04.2025 and 12.06.2025 as illegal and violative of Articles 14 and 21 of the Constitution of India.

The learned Counsel for the petitioner would submit that the petitioner is studying B.Tech Computer Science and Engineering (CSE) in respondent No.3-College which is autonomous College and she completed her III Year I-Semester without any backlogs and without shortage of attendance and she has also secured Certificate of Merit on Web Development using Codeless Tools that were conducted from 10.05.2023 to 15.05.2023.

The learned Counsel for the petitioner would further submit that while the petitioner is pursuing B.Tech–III Year, II-Semester, she was admitted in Yashoda Hospital, Somajiguda on 07.02.2025 due to lungs problem where she was diagnosed with “Right Primary Spontaneous Pneumothorax and surgery of “Right Uniportal Vatas Bullectomy and Mechanical Pleurodesis on 10.02.2025 and she was discharged on 14.02.2025 with an advice to take rest for a period of three weeks and thereafter she started attending classes from 05.03.2025, but unfortunately the same problem occurred while she was appearing for mid- examination and in view of the same the petitioner was again admitted in Yashodha Hospital on 13.03.2025. The petitioner came to know that due to failure of earlier surgery, the hospital authorities have performed procedure of “POST MALECOT INSERTION” on 13.03.2025, “ICD INSERTION” on 19.03.2025 and “TALK PLEURODESIS” on 24.03.2025 and was discharged on 26.03.2025 and advised her to take rest for a period of six weeks to he
