Since this batch of writ appeals are filed challenging the common order passed by the Hon’ble Single Bench of this Court, they are taken up for analogous hearing and are being decided by this Common Judgment.
2. Heard Mr. Tarun G. Reddy, learned counsel for the appellants in Writ Appeal Nos.753, 754, 763, 764, 765 and 766 of 2025; Mr. Avinash Desai, learned Senior Counsel representing Mr. M.Pranav, learned counsel for the appellants in Writ Appeal Nos.758 and 759 of 2025, Mr. Sirgapoor Sahi Reddy, learned counsel for the appellants in Writ Appeal No.749 of 2025, Mr. P.Sri Raghu Ram, learned Senior Counsel representing Mr. G.Chandra Sekhar Reddy, learned Standing Counsel for respondent No.2 in Writ Appeal Nos.753, 754, 758, 759, 763, 763, 765 and 766 of 2025, Mr. Peri Prabhakar, learned counsel for respondent No.4 in Writ Appeal Nos.749, 753 and 754 of 2025 & respondent No.3 in Writ Appeal Nos.758 and 759 of 2025, and Mr. S.Rahul Reddy, learned Special Government Pleader, representing learned Additional Advocate General for the State.

The instant batch of writ appeals have been filed by the appellants assailing the common order dated 11.07.2025 passed by the Hon’ble Single Bench of this Court in various I.As. those were filed in the respective writ petitions seeking for an interim direction of staying the effect and operation of the G.O.Ms.No.26, dated 30.06.2025, issued by the Higher Secondary Education Department of the Government exercising the powers under Section sub-rule (v) of Rule 4 of the Telangana Admission and Fee Regulatory Committee (for Professional Courses offered in Private Un-aided Professional Institutions) Rules, 2006, stating that for the present academic year 2025-26 the Private Un-Aided Professional Institutions in Telangana State may as of now charge fees that which was fixed for the earlier academic year 2022-25.

The Hon’ble Single Bench after hearing the various I.As. at length, considering the principles that are required for granting of interim relief found that, as such, no case of balance of convenience or irreparable loss has made out and for deciding the veracity of the G.O.Ms.No.26, dated 30.06.2025 which is under challenge, a detailed explanation of the case based upon the counters that would be filed by the respondents is required. Meanwhile, while refusing to grant an interim relief, the Hon’ble Single Bench has also directed respondent No.5 in the writ petitions to ensure that sufficient information is given to the students taking admission that the fees paid by them as of now be subject to the result of the writ petitions and for which appropriate circular in the official website or any other mode should be published forthwith. The Hon’ble Single Bench directed the respondent No.2 in the writ petitions apprising them of the responsibility and also with a direction that since the proposals submitted by each of the petitioner colleges for determining the fees and hearing on those proposals have been held in March, 2025, the process of determining the fees be completed within an outer limit of six (06) weeks from the date of the impugned common order passed by the Hon’ble Single Bench.

Learned Senior Counsel appearing for the appellants and the other learned counsel who had advanced their arguments in support of their appeals, tried to impress upon this Bench that the Hon’ble Single Bench has failed to appreciate the fact that the appellants herein had all made out a prima facie strong case in respect of the illegality on the part of the Government in determining the fees to be collected for the current academic year 2025-26 or for the next block period 2025-28.
