IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
THE HONOURABLE THE ACTING CHIEF JUSTICE P.SAM KOSHY
Nagaraja. – Appellant
Versus
Sri Keesara Ravi Kumar – Respondent
CRP 2274/2025

THE HONOURABLE THE ACTING CHIEF JUSTICE P.SAM KOSHY CIVIL REVISION PETITION No.2274 of 2025

ORDER:

The instant Civil Revision Petition has been filed by the petitioner under Article 227 of the Constitution of India assailing the order dated 20.12.2022, in I.A.No.938 of 2022 in O.S.No.1113 of 2025 (Old O.S. No.698 of 2022) passed by the Additional Senior Civil Judge-cum-Additional Chief Judicial Magistrate, R.R. District at Rajendrangar.

2. Heard Mr. G.Madhusudhan Reddy, learned counsel for the petitioners.

3. Vide the impugned order, the Trial Court has allowed the petition filed by the respondents herein and granted an ex-parte interim injunction against the petitioners herein.

4. The instant Civil Revision Petition has been filed after two and half years from the date the impugned order was passed.

5. During the course of deliberations, learned counsel for the petitioners submit that they have tried hard by filing the counter and also by insisting the Trial Court for taking up the I.A.No.938 of 2022 for an expeditious hearing, as an ex-parte interim injunction was in operation against the petitioners. However, the matter is getting adjourned on some pretext or the other, and since the matter is getting adjourned without any justifiable grounds, the petitioners are left with no other option, but to approach this Court for a suitable direction under the supervisory powers this Court enjoys under Article 227 of the Constitution of India.

6. Considering the enormous delay that has occurred on the part of the petitioners in assailing the impugned order dated 20.12.2022, this Court is not inclined to interfere with the same. Nonetheless, considering the grievance of the petitioners that the matter is getting lingered on trivial issues without any justifiable grounds, this Court feels it proper that disposing of the instant Civil Revision Petition would serve the purpose with a direction for an expeditious hearing on I.A.No.938 of 2022.

7. In view of the same, the instant Civil Revision Petition is disposed of directing the Additional Senior Civil Judge-cum-Additional Chief Judicial Magistrate, R.R. District at Rajendrangar, seized of O.S.No.1113 of 2025 (Old O.S. No.698 of 2022) to take up I.A.No.938 of 2022 and decide the same as expeditiously as possible, preferably within an outer limit of three (03) months from the next date of hearing.

8. As sequel, miscellaneous petitions pending if any, shall stand closed.

However there shall be no order as to costs.
