ORDER:
Aggrieved by the action of the respondents, more particularly, respondent No.2, in refusing to renew the Passport of the petitioner vide order dated 20.09.2024, the present writ petition is filed.
2. Heard Sri K.C. Reddy, learned counsel appearing for the petitioner and Sri Aravind Kumar Kata, learned Standing Counsel for Central Government, appearing on behalf of the respondents. With their consent, the Writ Petition is taken up for disposal at admission stage.
3. Learned counsel for the petitioner submits that the subject matter of the present writ petition is squarely covered by the adjudication of this Court in its order dated 16.02.2023 in W.P.No.4544 of 2023, and therefore, prays this Court to pass a similar order in the present writ petition also.
4. The above made submission is not seriously disputed by the learned Standing Counsel appearing on behalf of the respondents.
5. Having regard to the submissions made by learned counsel for the respective parties and for the reasons alike in the order of this Court dated 16.02.2023 in W.P.No.4544 of 2023, the Writ Petition is disposed of with the following directions:
i. The petitioner herein shall submit an undertaking along with an affidavit before the learned Additional Judicial Magistrate of First Class, Bhongiri, in C.C.No.675 of 2022, stating that she shall not leave India during pendency of the aforesaid Calendar Case without permission of the trial Court and that she shall co- operate with the trial Court in concluding the proceedings in the said Calendar Case;
ii. On filing such an undertaking along with the affidavit, the trial Court shall issue a certified copy of the same within two (02)
weeks therefrom;
iii. The petitioner herein shall submit the aforesaid undertaking along with the certified copy of this order before the Passport Officer/Authority concerned for consideration of her application for renewal of passport;
iv. On filing the said certified copies of order along with undertaking, the Passport Officer/Authority shall re-consider application the petitioner for renewal of passport vide application No.HY1076829232924, without reference to the impugned letter of respondent No.2 dated 20.09.2024 as well as the pendency of proceedings in C.C.No.675 of 2022, on the file of the Additional Judicial Magistrate of First Class, Bhongiri, and strictly in the light of the contents of the undertaking given by the petitioner for renewal of passport, in accordance with law, within three (03)
weeks thereafter;
v. On such issuance of the Passport, the petitioner shall deposit the original Passport before the trial Court in C.C.No.675 of 2022. However, the petitioner is at liberty to file an application before the learned Magistrate seeking permission to travel abroad, and it is for the learned Magistrate to consider the same in accordance with law.
Miscellaneous applications, if any, pending in this writ petition, shall stand closed. No costs.
