THE HONOURABLE SRI JUSTICE E.V.VENUGOPAL CRIMINAL PETITION No.8096 of 2021

ORDER

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (for short “Cr.P.C”) by the petitioner/accused No.7, seeking to quash the proceedings in Crime No.RC.06(A)/2-18-CBI/HYD on the file of the Central Bureau of Investigation, Anti Curruption Branch, Hyderabad for the offences under Sections 420, 468, 471 read with Section 409 of IPC and Section 13(2) read with Section 13(1)(c) and (d) of the Prevention of Corruption Act.

When the matter is taken up for consideration, T.Srujan Kumar Reddy, learned Special Public Prosecutor for respondent No.1-CBI would submit that the cause in this criminal petition does not survive as the crime in connection with this case has been investigated by the respondent No.1 and charge sheet has been laid before the competent criminal Court and yet to be numbered. After conducting investigation the petitioner herein, who is arrayed as accused No.7 is arrayed as accused No.5 in the charge sheet and seeks to dismiss this criminal petition as infructuous.

Ms.Padmaja, learned counsel representing learned counsel for the petitioner would submit that since the charge sheet is not yet been numbered, the cause in this criminal petition does survive as the basic ingredients made against the petitioner does not survive and it is squarely covered in the order passed by the Hon’ble Supreme Court of India in case of Gian Singh v State of Punjab1, hence she would seek to examine the matter and pass appropriate orders.

4. Since charge sheet has been already laid before the competent criminal Court in this case, this Court does not see any reason to keep this criminal petition pending, therefore the criminal petition is liable to be dismissed as infructuous.

5. Accordingly, this Criminal Petition is dismissed as infructuous. The petitioner is at liberty to work out the remedies in accordance with law, if cause so survives.

Miscellaneous applications, if any, pending shall stand closed.
