WRIT PETITION No.12181 OF 2016

O R D E R:

With the consent of both the parties, this Writ Petition is taken up for disposal.

2. This Writ Petition is filed, under Article 226 of the Constitution of India, seeking the following relief:

“...to issue appropriate Writ, order or direction, particularly one in the nature of Mandamus directing the respondents herein to grant compassionate pension along with arrears of pay fixed in pursuance of the recommendations of the IV Pay Commission pertaining to pay revision, considering her age and ailing health and pass...”

3. Heard Sri M.Ramakanth, learned counsel for the petitioner and learned Government Pleader for Services-I for respondent Nos.1 to 3.

Learned counsel for the petitioner submits that the petitioner was appointed as a Lecturer in English in the college of 4^th respondent on 12.12.1979 and his services were regularized vide order dated 22.07.1983. However, petitioner was terminated from the service by the 4th respondent – College vide proceedings dated 05.12.1998. On 09.02.2016, petitioner has submitted a representation to the 1^st respondent with a request to grant him compassionate allowance and the same is pending consideration. Therefore, learned counsel prays this Court to direct respondent No.1 to consider the representation, dated 09.02.2016 submitted by the petitioner and pass appropriate orders within a stipulated period of time.

5. Learned Government Pleader for respondents would submit that the petitioner was terminated from service on 05.12.1998 and the same has become final. However, since the representation, dated 09.02.2016, submitted by the petitioner is pending consideration, respondent No.1 will consider the same and pass appropriate orders, in accordance with law.

Having regard to the submissions made by learned counsel for the respective parties and without going into the merits of the case, this Writ Petition is disposed of directing respondent No.1 to pass appropriate orders in terms of Rule 40 of the Pension Rules, on the representation, dated 09.02.2016, submitted by the petitioner, strictly in accordance with law, as expeditiously as possible, preferably within a period of four (4) weeks from the date of receipt of a copy of this order and communicate a copy thereof to the petitioner.

Miscellaneous petitions pending, if any, shall stand closed.

There shall be no order as to costs.
