THE HON’BLE SRI JUSTICE PULLA KARTHIK WRIT PETITION No.19441 OF 2025

O R D E R:

With the consent of both the parties, this Writ Petition is taken up for disposal at the admission stage itself.

2. This Writ Petition is filed, under Article 226 of the Constitution of India, seeking the following relief:

“...to issue a writ order or a direction, more particularly one in nature of Writ of Mandamus directing the Respondents and more particularly Respondents No.5 may be directed to immediately release the electrical contract works done amount for the works done in the year 2020 for 13 different electrical contract works in Pedda Kothapally Mandal and Kodair Mandal amounting to around 12,00,000/- (Rupees Twelve Lakhs Only) as on the year 2020 along with 24% interest and to consider the latest representation dated 19-05-2025 and also declare non payment of pending bills for the works done above as against the principles of natural justice and also against the Article 14, 21 of Constitution of India and also declaring the highhanded action of the respondents in not considering the petitioners representations and not releasing the pending bills amount as arbitrary, unjust and violative of Article 14, 21 of the Constitution of India and against the principles of natural justice pass...”

Heard Sri V.Manoj, learned counsel representing M/s.Om Law Firm, learned counsel for the petitioner; learned Government Pleader for Energy for respondent No.1; and Sri N.Sreedhar Reddy, learned Standing Counsel for Southern Power Distribution Company of Telangana Limited, for respondent Nos.2 to 7.

Learned counsel for the petitioner submits that the petitioner is a licensed electrical contractor firm and in the year 2020, the petitioner has carried out electrical contract works for thirteen different projects in Pedda Kothapally Mandal and Kodair Mandal amounting to around Rs.12,00,000/-. Pursuant to completion of the said work, the respondents have sanctioned the said amount, which is clearly mentioned in the letter dated 27.10.2022. However, the said amount has not been released so far. Therefore, the petitioner made a representation to respondent No.5 on 19.05.2025 requesting to release the said amount but the same is pending consideration. Hence, learned counsel prays this Court to direct respondent No.5 to consider the representation of the petitioner, dated 19.05.2025, and pass appropriate orders within a stipulated period of time.

5. Learned Standing Counsel appearing for respondent Nos.2 to 7 submits that respondent No.5 will verify the records and pass appropriate orders on the petitioner’s representation, dated

19.05.2025, in accordance with law.

Having regard to the submissions made by learned counsel for the respective parties, this Writ Petition is disposed of directing respondent No.5 to pass appropriate orders on the representation, dated 19.05.2025, submitted by the petitioner, by verifying the genuineness of the petitioner’s claim, strictly in accordance with law, as expeditiously as possible, preferably within a period of two (2) months from the date of receipt of a copy of this order. It is made clear that if the petitioner’s claim is found to be genuine, the respondents shall release the said amount as expeditiously as possible.

Miscellaneous petitions pending, if any, shall stand closed.

There shall be no order as to costs.
