ORDER

This Criminal Petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS, 2023’) by the petitioner/accused No.33, to quash the proceedings against him in Crime No.177 of 2025 on the file of Nacharam Police Station, Rachakonda District, registered for the alleged offences punishable under Sections 329 (4) and 351(2) of BNS.

2. Heard Sri Yogesh Kumar Heroor, learned Counsel for the Petitioner and Sri M.Vivekananda Reddy, learned Assistant Public Prosecutor for respondent No.1-State.

Learned counsel for the petitioner submitted that the petitioner is not at all connected with the alleged offence, and that the scope of his visit was limited to making observations from outside the premises and verifying data available in the public domain. It is submitted that while the petitioner was verifying information from outside the premises, a security guard from the company allegedly snatched his mobile phone. The petitioner followed the guard to the main gate, where, after a brief discussion, he was forcibly taken inside the premises and wrongfully detained. The petitioner has requested that CCTV footage of the incident be furnished, and further submitted that the charge sheet has not yet been filed.

4. On the other hand, the learned Assistant Public Prosecutor submitted that the charge sheet has already been filed. However, it is fairly admitted that the charge sheet does not contain any reference to the CCTV footage.

5. Considering the submissions made by both parties, the trial Court is directed to dispose of the petitions filed by the petitioner, vide S.R. No. 1650 of 2025 (seeking return of property) and S.R. No. 1745 of 2025 (seeking CCTV footage), within one (01) week from the date of receipt of a copy of this order. Liberty is granted to the petitioner to file a fresh petition, if so advised, after the trial Court passes appropriate orders on the said petitions.

6. With the above direction, this Criminal Petition is disposed of.

Miscellaneous applications, if any pending, shall also stand closed.
