O R D E R:

With the consent of both the parties, this Writ Petition is taken up for disposal at the admission stage itself.

2. This Writ Petition is filed, under Article 226 of the Constitution of India, seeking the following relief:

“...to issue writ order or direction more particularly one in the nature of Writ of Mandamus by declaring the action of Respondent No.3 in issuing the impugned notice vide Rc.No.32/2022/D(ii) dated 17.05.2025 directing the petitioner to evict from his Plot No.5 admeasuring 166.66 sq. yards or 139.27 sq. mtrs situated in Survey No.395 Location Lalsadgudem, Gajularamaram, Medchal Malkajgiri District within a period of 15 days as illegal, arbitrary and in contravention of proviso to Section 20(4) of the Telangana Forest Act, 1967 apart from violation of Article 14, 19(1)g, 21, 300-A of Indian Constitution and consequently to set aside the impugned notice vide Rc.No.32/2022/D(ii) dated 17.05.2025 and pass...”

3. Heard Sri Ch.Jagannatha Charry, learned counsel for the petitioner and learned Government Pleader for Forests for the respondents.

Learned counsel for the petitioner submits that the petitioner is the absolute owner and possessor of land in Plot No.5 admeasuring 166.66 sq. yards in Sy.No.395, situated at Lalsabgudem, Gajularamaram, Medchal-Malkajgiri District, and the same was purchased by virtue of registered sale deed vide Document No.14036 of 2020, dated 04.08.2020 on the file of S.R.O., Quthbullapur. Subsequent to the purchase, the petitioner submitted an application for LRS vide No.c/GHMC/046752/2020, dated 02.10.2020. While so, respondent No.3 issued impugned notice, dated 17.05.2025, requesting the petitioner to evict from the said illegal encroached forest land, for which, the petitioner has submitted his explanation/representation on 02.06.2025 to respondent No.3 but the same is pending consideration. Therefore, learned counsel prays this Court to direct respondent No.3 to consider the explanation/representation, dated 02.06.2025, submitted by the petitioner and pass appropriate orders within a stipulated period of time.

5. Learned Government Pleader appearing for the respondents fairly submits that respondent No.3 will consider the explanation/ representation of the petitioner, dated 02.06.2025, and pass appropriate orders in accordance with law.

Having regard to the submissions made by learned counsel for the respective parties and without going into the merits of the case, this Writ Petition is disposed of directing respondent No.3 to pass appropriate orders on the explanation/representation, dated 02.06.2025, submitted by the petitioner, strictly in accordance with law, after putting the affected parties on notice and affording them an opportunity of hearing, as expeditiously as possible, preferably within a period of four (4) weeks from the date of receipt of a copy of this order and communicate a copy thereof to the petitioner. Till the disposal of the aforesaid explanation/ representation, both the parties are directed to maintain status-

quo, obtaining as on today, in respect of the subject property. Miscellaneous petitions pending, if any, shall stand closed.

There shall be no order as to costs.
