THE HON’BLE SRI JUSTICE K. LAKSHMAN CIVIL REVISION PETITION No. 1094 of 2025

ORDER:

Heard Sri G. Chandra Sekhar, learned counsel for petitioner.

2. This Civil Revision Petition is filed under Article 227 of the Constitution of India seeking a direction to the learned Junior Civil Judge, Nandimyadaram, Peddapalli District, to dispose of I.A.No.89 of 2024 filed by the petitioner for grant of police aid, in accordance with law, as expeditiously as possible.

3. The petitioner herein filed a suit in O.S.No.97 of 2023 against the respondents for perpetual injunction. Along with the suit, he has filed I.A.No.11 of 2023 seeking temporary injunction. Vide order dated 23.04.2024, the learned Junior Civil Judge-cum-Judicial Magistrate of First Class, Nandimyadaram, allowed the said I.A. and it is an order on contest. Feeling dissatisfied with the said order, respondents/defendants filed CMA No.1 of 2024. The same was dismissed by the learned Principal District and Sessions Judge, Peddapalli, on 09.08.2024.

4. According to the petitioner, despite the said injunction order dated 23.04.2024, respondents are interfering with the possession of the petitioner over the suit schedule property. Therefore, he has filed an application vide I.A.No.89 of 2024 seeking police aid, on 11.06.2024. Even then, the trial Court is not disposing of the said I.A. Hence, petitioner filed the present Civil Revision Petition.

5. As discussed supra, the order dated 23.04.2024 passed by the trial Court in I.A.No.11 of 2023 in O.S.No.97 of 2023 is on contest. The appeal filed by the defendants vide CMA No.1 of 2024 was dismissed on 09.08.2024. As the respondents are interfering with the possession of the petitioner over the suit schedule property, he has filed an application vide I.A.No.89 of 2024 seeking police aid, on 11.06.2024. The trial Court kept the said application pending.

6. In the light of the said discussion and in view of the nature of relief sought by the petitioner, notice on the respondents is waived off by invoking power of this Court under Article 227 of Constitution of India.

Accordingly, this Civil Revision Petition is disposed of directing the trial Court to dispose of I.A.No.89 of 2024 in I.A.No.11 of 2023 in O.S.No.97 of 2023, filed by the petitioner seeking police aid, in accordance with law, within thirty (30) days from the date of receipt of copy of this order, taking into consideration the parameters laid down by this Court vide order dated 09.06.2025 in C.R.P No.2536 of 2024.

There shall be no order as to costs.

Miscellaneous applications, if any pending, shall stand closed.
