ORDER:

Heard learned counsel for the petitioners and learned Assistant Government Pleader for Stamps and Registration for the respondents. With their consent, this Writ Petition is disposed of at the stage of admission itself.

Learned counsel for the petitioners submits that the petitioners filed the writ petition challenging the action of the respondent No.3 in refusing to register and release the pending document No.P113/2023 dated 18.05.2023 vide Intimation of Refusal No.17/2023 dated 20.05.2023 by following the reasons as mentioned below:

“1. Ranga Reddy District Gazette Notification R.R.No.83 communicated by Joint Collector Rangareddy vide File No.

E5/4730/2013/Quthbullapur, Dt: 25-09-2013.

2. Deputy Collector & Tahasildar Quthbullapur Mandal File No.B/583/2012, Dt. 17-02-2012 and

3. Gazette Notification No. 134, Dt: 10-03-2005 and G.O

Ms. No. 292, Revenue (Registration. I), 9th March 2005 communicated by Commissioner and Inspector General (R&S), Hyderabad vide File No. G1/4661/2005, Dt.02-07-

2005.”

Learned counsel for the petitioner further submits that the subject matter of this writ petition is squarely covered by the common order dated 22.03.2024 passed by this Court in W.P.No.9645 of 2021 and W.P.No.26353 of 2023, wherein it is stated that File No.G1/4661/2005 dated 02.07.2005 is not in accordance with the provisions of the Section 22- A(1)(e) and 22(1)(2) and also as per clause (vi) of the guidelines issued in the case of Vinjamuri Raiagopala Chary v. State of Andhra Pradesh and File No.E5/4730/2013/Quthbullapur, dated 25.09.2013 is set aside. In spite of the same, the respondent No.3 is relying upon the same files dated 02.07.2005 and 25.09.2013 and issued impugned Intimation of Refusal No.17/2023 dated 20.05.2023. Hence, learned counsel for the petitioner requested this Court to set aside the said files dated 02.07.2005 and 25.09.2013 by following the common order dated 22.03.2024 passed by this Court in W.P.No.9645 of

2021 and W.P.No.26353 of 2023.

4. Learned Assistant Government Pleader for Stamps and Registration is fairly acceded that the said files dated 02.07.2005 and 25.09.2013 are set aside by this Court vide common order dated 22.03.2024 passed in W.P.No.9645 of 2021 and W.P.No.26353 of

2023 and requested to pass appropriate orders.

In view of the submissions made by both the sides and on perusing the entire material on record, this writ petition is disposed of directing the respondent No.3 to receive, register and release the pending Document No.P113/2023 on 18.05.2023 without reference to the Intimation of Refusal No.17/2023 dated 20.05.2023, subject to the petitioner complying with the provisions of the Indian Registration Act, 1908, and Indian Stamps Act, 1899. It is also open to the Registering Authority to refuse the document presented by the petitioner, if any other objections by duly assigning the reasons and communicate the same to the petitioner.

It is made clear that mere registration of the document does not confer title on the subject property and it is also made clear that this order would not have any bearing on all those matters where title/rights of the parties are pending before the authorities either in revision/appeals for adjudication and in any other case this order also does not preclude the parties in asserting their rights before a competent Court of law. However, there shall be no order as to costs.

7. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
