ORDER

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

“….to issue a writ, order or direction more particularly one in the nature of writ Mandamus declaring the action of the 3rd respondent in not mutating my name in revenue records for the land bearing survey number 71 admeasuring Ac.1.34 Gts situated at Rachuloor Revenue Village and Gram Panchayat, Kandukur Mandal, Ranga Reddy District instead of Ac.0.22 gts pursuant to my representation dated 10.04.2025 as being illegal, arbitrary and unconstitutional and violation of Article 300A of Constitutional Of India and consequently direct the respondents to mutate petitioners name for the land bearing survey number 71 admeasuring Ac.1.34 Gts situated at Rachuloor Revenue Village and Gram Panchayat, Kandukur Mandal, Ranga Reddy District..…”

2. Considered the submissions of learned counsel for the petitioner; Sri L. Ravinder, learned Assistant Government Pleader for Revenue appearing for the respondents and with their consent, this writ petition is being disposed of at the admission stage.

It is stated that the petitioner is the owner and possessor of lands admeasuring Ac.1.34 guntas in Sy.No.71 situated at Rachuloor Revenue Village and Gram Panchayat, Kandukur Mandal, Ranga Reddy District, having purchased the same under registered sale deed bearing document No.3880 of 2014, dated 27.11.2014, and since the date of purchase, he is in peaceful possession and enjoyment of the subject property. It is further stated that after conducting enquiry, the respondent authorities have issued mutation proceedings vide No.B/789/2017, dated 07.08.2017 mutating the name of the petitioner in the revenue records only to the extent of Ac.0.22 guntas instead of Ac.1.34 guntas, therefore, the petitioner has submitted number of representations for mutating his name for the remaining extent of lands, but no action has been taken by the respondent authorities till date.

Learned Assistant Government Pleader for Revenue appearing for the respondents submitted that pending consideration of the representation submitted by the petitioner, the Government has repealed the Telangana Rights in Land and Pattadar Pass Books Act, 2020 (for short ‘the Act, 2020’) and enacted new Act called as the Telangana Bhu Bharati (Record of Rights in Land) Act, 2025 (for short “the Bhu Bharati Act”). Learned Assistant Government Pleader for Revenue further submitted that as per Rule 4 of the Bhu Bharati Rules, any person aggrieved by the entries made in the revenue records, shall make an application in the prescribed format before the Tahsildar through the website prescribed for rectification of the entries, duly paying the prescribed fees.

In view of the above submissions, this Court deems it appropriate to dispose of this writ petition permitting the petitioner to make appropriate online application in the prescribed format in Bhu Bharati Web Portal seeking correction/rectification of the entries. In the event of such application being made by the petitioner and if the same fulfils all the requirements under the provisions of the Telangana Bhu Bharati (Record of Rights in Land) Act, 2025 (for short “the Bhu Bharati Act”) and the Rules made thereunder, the respondent- authorities shall examine and consider the case of the petitioner, after issuing notices to all the interested and effected parties by mutation of the names of the petitioner. In any event, if the application of the petitioner does not fulfil the requirements and eligible for mutation of his name under the Bhu Bharati Act and the Rules made thereunder, the respondent-authorities shall pass a reasoned order, in accordance with law and communicate the same to the petitioner. The entire exercise shall be completed within a period of eight (08) weeks from the date of filing such application.
