ORDER

Heard Sri Chikkudu Prabhakar, learned counsel for the petitioner, learned Assistant Government Pleader for Industries and Commerce appearing for respondent Nos.1 and 2, learned Assistant Government Pleader for Revenue appearing for respondent Nos.3 and 4 and learned Assistant Government Pleader for Land Acquisition appearing for respondent No.5. Perused the record.

2. This writ petition is filed seeking the following prayer:-

“…

declaring the inaction of the respondents on the applications made before 4^th and 5^th respondents by the petitioner dated 26.11.2012 and 17.09.2014 respectively, as illegal …”

Brief facts in this Writ Petition are that the father of the petitioner viz., late Buchaiah claims to be the owner and possessor of agricultural land to an extent of Ac.2-25 gts., in Sy.No.1598 situated at Madikonda Revenue village, Hanmakonda mandal, District Warangal, which is the ancestral property of petitioner’s father. The respondent authorities have acquired the said land and an Award was passed by respondent No.5, vide proceedings Rc.No.A/6687/81, dated 23.09.1986, for the 2^nd respondent own utilization purpose in the year 1986. It is further submitted that though the land of petitioner’s father was acquired in the year 1986, no compensation has been paid till date. The petitioner has made representations dated 26.11.2012 and 17.09.2014 to the respondent Nos.4 and 5 respectively requesting to pay compensation to the land acquired from the father of the petitioner but they did not take any action on the said representations. Aggrieved by the said inaction of respondents, petitioner filed the present Writ Petition.

Learned counsel appearing for the petitioner draws attention of this Court to the proceedings / Award dated 23.09.1986 passed by the Land Acquisition Officer and Revenue Divisional Officer, Warangal – respondent No.5, wherein the name of the petitioner’s father has been shown in the said Award and similarly the name of the petitioner’s father has been continued as ‘pattedar’ in the details submitted in Adangal pahani dated 30.10.2014 to the extent of Ac.2-25 gts., in Sy.No.1598 situated at Madikonda Revenue village.

Though various grounds are raised learned counsel appearing for the petitioner restricted/confined his prayer to direct the respondent authorities to pass appropriate orders on the aforesaid representations submitted by the petitioner to grant compensation to the land acquired from the father of the petitioner.

6. Learned Government Pleader submits that respondent Nos.4 and 5 will dispose of the aforesaid representations filed by the petitioner and pass appropriate orders, in accordance with law.

Recording the submissions made by learned counsel for the parties and with their consent and without going into the merits of the case, this writ petition is disposed of directing respondent Nos.4 and 5 to dispose of the representations dated 26.11.2012 and 17.09.2014 submitted by the petitioner and after verification of the petitioner’s identity, rights/title and pass appropriate orders, strictly in accordance with law, within a period of two (2) months from the date of receipt of a copy of this order. There shall be no order as to costs.

Miscellaneous petitions, pending, if any, shall stand closed.
