AND CONTEMPT CASE No.2798 OF 2024

ORDER:

This Contempt Case, under Sections 10 to 12 of the Contempt of Courts Act, 1971, is filed seeking to punish the respondent for willful and deliberate disobedience of the order, dated 05.09.2024, passed by this Court in W.P.No.1052 of 2024.

2. Heard Sri Prabhakar Chikkudu, learned counsel for the petitioners and Sri P.S. Rajasekhar, learned counsel for the respondent.

Learned counsel for the petitioners had contended that this Court was pleased to dispose of the subject Writ Petition by directing the respondent to exercise the power under paragraph No.12 of the notification, dated 02.06.2018, and take steps to fill up the unfilled vacancies. The respondent instead of complying with the order passed by this Court has passed rejection orders, dated 02.11.2024. A perusal of the rejection orders discloses that the order passed by this Court is not implemented in its true letter and spirit. Therefore, appropriate orders be passed in the Contempt Case by summoning the respondent for violating the order passed by this Court.

4. On the other hand, learned counsel for the respondent had contended that the order passed by this Court has been complied with. The cases of the petitioners were considered in terms of the vide order passed by this Court and they were rejected orders, dated 02.11.2024. The posts, which were earmarked for Persons with Disabilities (PwD) and BC-C category, cannot be converted into general vacancies and filled up with the petitioners. Therefore, there is no willful or deliberate disobedience on the part of the respondent and the Contempt Case is liable to be dismissed.

This Court, having considered the rival submissions made by the learned counsel for the parties, is of the considered view that the respondent has considered the cases of the petitioners in terms of the order, dated 05.09.2024, passed by this Court and rejected the vide same orders, dated 02.11.2024. In view of the same, this Court is of the view that the order passed by this Court has been complied with.

6. Accordingly, the Contempt Case is closed. However, liberty is granted to the petitioners to challenge the rejection orders, dated 02.11.2024, in accordance with law. There shall be no order as to costs.

Miscellaneous Applications, if any, pending in this Contempt Case shall stand closed.
