ORDER:

With the consent of both the parties, this Writ Petition is disposed of at the admission stage itself.

2. Heard Sri B. Shiva Kumar, learned counsel for the petitioners, and learned Government Pleader for Home, appearing for the respondents. Perused the material on record.

The case of the petitioners is that they were appointed as Constables (Civil) in the respondent department and were subsequently promoted to the post of Head Constable on 15.02.2018 along with approximately 440 others by respondent No.4 - The Commissioner of Police, Cyberabad, in appreciation of the petitioners’ services. The petitioners are presently working in various police stations under the Rachakonda Commissionerate within the jurisdiction of the V-Zone of DIG Yadadri Range. Despite discharging their duties as Head Constables without any adverse remarks, the petitioners’ probation has not been declared.

4. The petitioners submitted multiple representations, including one dated 25.04.2023, requesting regularization of their services and fixation of seniority in the Head Constable category.

In response, respondent No.2 - The Director General of Police, issued a Memo dated 26.08.2023, directing all unit officers to submit proposals for assigning notional promotion dates effective from 15/16.02.2018 to facilitate declaration of probation. However, no action has been taken in this regard. Meanwhile, by proceedings dated 09.06.2025, respondent No.3 fixed notional seniority for Head Constables converted from PCs (A.R) to PCs (Civil) as per G.O.Ms.No.19, but, excluding the petitioners from the same. It is further submitted that constables promoted as Head Constables in 2022 and 2023 had their probation declared on 11.11.2024 and 06.03.2025 respectively, thereby making them eligible for further promotion as ASI ahead of the petitioners. Aggrieved by the inaction of the respondent authorities, the petitioners have filed the present Writ Petition.

5. Learned counsel for the petitioners submits that appropriate orders may be passed in this Writ Petition by directing the respondents to consider the representation submitted by the petitioners on 25.04.2023 and pass appropriate orders in accordance with law within a reasonable period.

6. Learned Government Pleader for Home, appearing for the respondents, submits that he has no objection for the disposal of the representation of the petitioners dated 25.04.2023.

7. Taking into consideration the submissions made by the learned counsel for the respective parties, without going into the merits of the case, this Writ Petition is disposed of, directing the respondent authorities to consider the petitioners’ representation dated 25.04.2023, and pass appropriate orders in accordance with law, as expeditiously as possible, preferably, within a period of six (6) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel, miscellaneous applications pending, if any, in this Writ Petition, shall stand closed.
