ORDER:

This writ petition is filed seeking following relief:

“For the reasons stated in the accompanying affidavit, it is prayed that this Hon’ble Court may be please to pass an order or a writ or a direction, most specifically one in the nature of a writ of Mandamus declaring the action of the respondents in stopping the Rytu Bandu to the petitioners and consequently direct the respondents to release the Rytu Bandu to the petitioners and pass such order or further orders are deemed fit and proper in the circumstances of the case and in the interest of justice.” 2. It is stated that the petitioners are the owners and possessors of agricultural land admeasuring Acs. 12.33 guntas in Survey Nos.106 (106/A) and 108 (108/A), situated at Metichandapur Village, Marriguda Mandal, Nalgonda District (for short, ‘the subject land’), having purchased the same from its original owner Sri Dasari Muthaiah through an ordinary Sale Deed dated 03.03.1996. It is further stated that the petitioners placed the ordinary Sale Deed dated 03.03.1996 before the Mandal Revenue Officer (Tahsildar), Marriguda for implementation of the Sale Deed and to issue patta in favour of the petitioners, but the revenue authorities informed the petitioners that unless registered Sale Deed of the Vendor Muthaiah is produced, the land cannot be transferred in favour of the petitioner. It is further stated that the minor son of Sri Dasari Muthaiah executed a registered Sale Deed in favour of the petitioners and the petitioners were issued old pattadar passbook vide No.422094 and new e-pattadar passbooks vide Nos.T28160090136 and T2816009039. It is further stated that one Dasari Narsimha in order to harass the petitioners has filed a suit vide O.S.No.181 of 2023 and the Principle Junior Civil Judge at Devarakonda has granted an ad-interim injunction over the subject land vide order dated 27.04.2023 in I.A.No.451 of 2023 in O.S.No.181 of 2023. The grievance of the petitioners is that they were receiving Rythu Bandhu amounts without any interruption, but from the year 2023, the petitioners are not receiving the Rythu Bandhu amount in view of the said ad-interim injunction order.

Hence, the present writ petition.

Considered the submissions of the learned counsel for the petitioners, learned Assistant Government Pleader for Agriculture for respondent Nos.1, 2, 4, 5 and 7 and learned Assistant Government Pleader for Revenue appearing for respondent Nos.3 and 6 and with their consent, this writ petition is disposed of at the admission stage.

Learned counsel for the petitioners contended that the ad-interim injunction order dated 27.04.2023 granted in I.A.No.451 of 2023 in O.S.No.181 of 2023 operates only to the extent of creating any third party interest over the subject land, but there is no prohibition for enjoying the subject land in the said order, pending adjudication of the suit. Learned counsel further contended that since the petitioners are cultivating the subject land and since there is no prohibition for cultivation of the subject land in the said ad-interim injunction order, the petitioners are entitled to receive the Rythu Bandhu amount.

In view of the said submissions, since the said issues have not been considered by the revenue authorities, this Court is of the opinion that the ends of justice would be met if the petitioners are permitted to make an application to the respondent authorities for release of Rythu Bandhu amount within a period of two (02) weeks from today. In the event of such application being made by the petitioners and if the same fulfills all the requirements for sanction of Rythu Bandhu amount, the respondent authorities shall examine and consider the application of the petitioners for release of Rythu Bandhu amount, uninfluenced by the ad-interim injunction order dated 27.04.2023 granted in I.A.No.451 of 2023 in O.S.No.181 of 2023.
