ORDER:

This writ petition is filed seeking the following relief:

“....to issue a writ or order or direction more particularly one in the nature of Writ of Mandamus declaring action of the respondent No.1 to 4 in not considering the petitioner representation dt.30/01/2025 for implementation of order of Authority under payment of Gratuity Act, 1972 and Asst. Labour Commissioner (Central), Hyderabad in P.G.No.132 of 2023 dt.9/12/2024 amounting to Rs.2,74,520.00 (Rupees Two Lakhs Seventy Four Thousand Five Hundred and Twenty Only) as simple interest alias 10 percentage per annum w.e.f. 30/04/2022 to 13/09/2023 on Rs.20,00,00.00 is illegal, arbitrary and in violation of principles of natural justice and consequently direct the respondent No.1 to 4 payment of Gratuity Act, 1972 and Asst. Labour Commissioner (Central), Hyderabad in P.G.No.132 of 2023 dt.9.12.2024 amounting to Rs.2,74,520.00 (Rupees Two Lakhs Seventy Four Thousand Five Hundred and Twenty Only) as simple interest alias 10 percentage per annum w.e.f. 30/04/2022 to 13/09/2023 on Rs.20,00,00.00 and pass pass...”

2. Heard Sri Naresh Verma Bavandlapelli, learned counsel appearing for the petitioner and Sri C. Raman Kumar Reddy, learned Standing counsel for SCCL appearing for respondent Nos.1 to 4 and perused the material available on record.

3. Learned counsel for the petitioner submits that the petitioner was Ex. Employee of respondent Company, filed an application vide Samadhan ID No.300049426, dated 07.10.2023 in Form ‘N’ under Rule 10 (1) of the Payment of Gratuity (Central) Rules, 1972, requesting the Controlling Authority and Assistant Labour Commissioner (Central), Hyderabad, to issue necessary directions to the Singareni Collieries Company Limited, who failed to pay the Gratuity amount as per the provisions of Payment of Gratuity Act, 1972. For the said relief, the petitioner made a representation dated

30.01.2025, before the 2^nd and 3^rd respondents.

4. Learned Standing Counsel appearing for the respondents submits that they have no objection to dispose of the representation dated 30.01.2025 submitted by the petitioner and pass appropriate orders, in accordance with law.

5. This Court having considered the rival submissions made by the respective parties, is of the considered view, that this writ petition can be disposed of, directing the respondents to consider the representation dated 30.01.2025, submitted by the petitioner, and pass appropriate orders thereon, in accordance with law, within a period of six (06) weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition is disposed of.

No order as to costs.

As a sequel, miscellaneous applications pending, if any, in this Writ Petition, shall stand closed.
