THE HONOURABLE SRI JUSTICE E.V.VENUGOPAL CIVIL REVISION PETITION No.1937 OF 2025

ORDER:

This Civil Revision Petition is filed under Article 227 of the Constitution of India, by the petitioner/plaintiff seeking for early disposal of I.A.No.517 of 2018 in O.S.No.121 of 2011 on the file of the learned Senior Civil Judge at Jagitial (for short, “the trial Court”).

2. Heard Mr.Boosa Shivachandra, learned counsel appearing for the petitioner and perused the record.

3. The petitioner herein is the plaintiff and the respondents herein are the defendants before the trial Court. For the sake of convenience hereinafter, parties are referred to as the plaintiff and the defendants.

4. The brief facts of the case are that the plaintiff and defendant No.2 are the sisters and defendant No.1 is their brother and they are children of Gaddam Ashalu and Gaddam Narasamma. Gaddam Narasamma is the absolute owner and possessor of land to an extent of Acs.7.14 guntas in Sy.No.35 and Ac.1.09 guntas in Sy.No.340/A with a suit schedule A properties and constructed a residential house No.2-61 which is suit schedule B property. Thus suit schedule A and B properties are ancestral joint properties of plaintiff and defendants and they are in joint possession and enjoyment over the same. After the demise of Gaddam Ashalu and Gaddam Narasamma, disputes arose between the plaintiff and the defendants and the defendants are mismanaging the joint family properties. Hence, it became difficult to the plaintiff to continue her joint status along with the defendants. Therefore, the plaintiff on 31.07.2011 demanded defendant No.1 to effect partition and to allot 1/3^rd share to her. But the defendants declined and started efforts to alienate part of suit properties to 3^rd parties. Hence, the plaintiff filed a Suit vide O.S.No.121 of

2011 before the learned trial Court.

The trial Court vide its order dated 07.12.2017 has passed the preliminary decree to suit schedule properties into 3 equal shares with metes and bounds and out of which, the plaintiff is entitled for 1/3rd share. The plaintiff again filed an Interlocutory Application vide I.A.No.517 of 2018, before the trial Court, seeking to pass a final decree by allotting separate 1/3^rd share with metes and bounds to the her in the suit schedule property and by putting her in separate possession, which is pending for adjudication.

Mr.Boosa Shivachandra, learned counsel appearing for the petitioner/plaintiff would submit that the present Civil Revision Petition is filed seeking for early disposal of I.A.No.517 of 2018 in O.S.No.121 of 2011. Learned counsel would further submit that the suit is of the year 2011 and decided in the year 2017 and the I.A. is of the year 2018, and the trial Court may be directed to dispose of the I.A. as early as possible.

Having considered the submissions made by learned counsel for the petitioner/plaintiff, without going into the merits of the case, this Court deems it appropriate to dispose of this Civil Revision Petition by directing the trial Court to dispose of the I.A.No.517 of 2018 in O.S.No.121 of 2011 as expeditiously as possible, strictly in accordance with law.

8. With the above observations, this Civil Revision Petition is disposed of. There shall be no order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
