2025 Supreme(Online)(Tel) 51687

IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
THE HONOURABLE SRI JUSTICE P.SAM KOSHY
Shanker Singh – Appellant
Versus
Sunil Singh – Respondent
CRP 1322/2025

ORDER :

The present Civil Revision Petition has been filed under Article

227 of the Constitution of India challenging the docket order, dated 20.01.2025, passed in I.A.No.207 of 2025 in C.M.A.No.2 of 2025 by the VI Additional District and Sessions Judge-cum-Family Court, Ranga Reddy District, at Kukatpally (for short ‘the impugned order’).

2. Heard Mr.Syed Mounis Jafer Abidi, learned counsel for the petitioners. Perused the material available on record.

3. The learned first appellate court seized of C.M.A.No.2 of 2025 had issued urgent notices to the respondents and has fixed the matter on 12.02.2025. Thereafter, the matter was adjourned on a couple of occasions and the matter now stands posted on 25.06.2025 for the same cause.

4. The Civil Miscellaneous Appeal is one which has been filed against the order of refusing to grant injunction, therefore, it is necessary for the court seized of C.M.A.No.2 of 2025 to decide the C.M.A.No.2 of 2025 or the I.A. filed in the said C.M.A.No.2 of 2025 for grant of ad interim relief at the earliest. Urgent notices were issued as early as in January 2025, by now, it is more than six months and in between the matter has been listed for more than couple of occasions. 5. In view of the same, this Court does not find any case for grant of injunction exercising the supervisory jurisdictional powers of this Court. Rather, this Court is of the considered opinion that, ends of justice would meet, if the First Appellate Court seized of C.M.A.No.2 of 2025 is directed to ensure that I.A.No.207 of 2025 is taken up for consideration and decide the same as early as possible, preferably within a period of 45 days from the next date of hearing.

6. With the above direction, the present Civil Revision Petition stands disposed of.

As a sequel, miscellaneous applications pending if any, shall stand closed.
