ORDER : (Per Hon’ble Sri Justice Abhin and Kumar Shavili When the matter is taken up for hearing, learned counsel for the petitioner had contended that the Lok Adalat, instead of disposing of the case in accordance with the compromise memo, has adjudicated the case in respect of entire land, which is contrary to the terms of the compromise memo filed by the petitioners.
2. Learned counsel for the respondents did not dispute about the said fact and contended that let the award passed by the Lok Adalat Bench be set aside.
3. In view of the above submissions, the award, dated 28.12.2022 passed in Lok Adalat Case No. 1168 of 2022 by the Lok Adalat Bench, Nizamabad, is liable to be set aside and accordingly, it is set aside, as admittedly, the Lok Adalat award is contrary to the compromise memo filed by the parties. Therefore, the Lok Adalat is directed to dispose of the case strictly in terms of the said compromise memo.
4. With the above observations/directions, the Writ Petition disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
