ORDER:
The present Criminal Petition is filed under Sections
482 of Cr.P.C. seeking to quash S.T.C.No.134 of 2022, dated 22.06.2022 on the file of the learned I Judicial First Class Magistrate at Nizamabad (for short, ‘the trial Court’).
2. The brief facts of the case are that the petitioner/accused and her husband borrowed an amount of Rs.1,00,00,000/- on 30.10.2021 from the complainant. After receiving the said amount, the accused executed a pronote in favour of the complainant, agreeing to repay the said amount as and when he requires. It is further averred in the complaint that after several demands made by the complainant, the husband of the accused issued two cheques (i) cheque bearing No.004897, dated 09.05.2022 for an amount of Rs.50,00,000/- and (ii) cheque bearing No.398609, dated 09.05.2022 for an amount of Rs.50,00,000/-. When complainant presented the cheques in his bank for realization, they were dishonored with a Memo dated 10.05.2022 with the reason “Drawers signature differs”, which the cheque was filled by the appellant and delivered to the complainant, and requested to present the cheque w
