THE HONOURABLE SRI JUSTICE K.SARATH WRIT PETITION No.3936 OF 2021

ORDER:

1. This Writ Petition is filed questioning the action of the respondent Nos.2 and 3 in conducting the Survey in respect of land in Sy.Nos.277, 278 and 279 situated at Kandukur Gram Panchayath, Kandukur Revenue Village and Mandal, Ranga Reddy District, without issuing any notice to the petitioner or without passing any order on the objection petitions of the petitioner dated 09.02.2021 and 11.02.2021 and sought a direction to the respondent Nos.2 and 3 not to conduct any survey in respect of the above said lands.

submit that while ordering Notice Before Admission in the

instant writ petition, this Court granted interim order on 23.02.2021 directing the respondent Nos.2 and 3 not to conduct any survey in respect of the lands in Sy.Nos.277, 278 and 279 situated at Kandukur Gram Panchayath, Kandukur Revenue Village and Mandal, Ranga Reddy District in view of pendency of O.S.No. 55 of 2021 filed by the respondent No.4 and O.S.No.79 of 2021 filed by the petitioner on the file of Principal Senior Civil Judge, Ranga Reddy District at L.B.Nagar, making rival claims to the said lands and also pendency of few other suits as mentioned in the objections filed by the petitioner on 09.02.2021. In spite of lapse of more than four years, the respondents did not choose to file counter or vacate petition denying the averments made by the petitioner in the writ affidavit and requested to make the interim order passed by this Court as absolute.

Revenue would submit that the respondent-authorities would conduct the survey in respect of the suit lands only after disposal of the civil suits pending between both the parties.

5. In view of the submissions made by the both sides, the Writ Petition is disposed of directing the respondent Nos.2 and 3 not to conduct any Survey in respect of lands in Sy.Nos.277, 278 and 279 situated at Kandukur Gram Panchayath, Kandukur Revenue Village and Mandal, Ranga Reddy District till the disposal of the suits in O.S.No. 55 of 2021 and O.S.No.79 of 2021 on the file of Principal Senior Civil Judge, Ranga Reddy District at L.B.Nagar.

6. Miscellaneous applications, if any, pending in this Writ Petition shall also stand closed. No order as to costs.
