ORDER

This Criminal Petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS, 2023’) seeking quashment of the proceedings in C.C.No.375 of 2024 on the file of the V Additional Metropolitan Magistrate-cum-I Additional Junior Civil Judge, Malkajgiri-Medchal District Uppal at L.B.Nagar against the petitioner.

2. Heard Mr.K. Venumadhav, learned counsel for the petitioner and Mr.Jithender Rao Veeramalla, learned Additional Public Prosecutor appearing for the respondent No.1-State.

3. The petitioner is sole accused in C.C.No.375 of 2024 for the offences under Sections 447 and 427 of IPC.

4. The case of the prosecution in brief is that the de facto complainant claiming ownership over 71 plots in the panchayat layout in Sy.No.752 situated at Kakatiya Nagar Colony, Yamnampet village, Ghatkesar Mandal, sold the plots. On 10.08.2023 at about 12 noon the petitioner/accused along with friends illegally trespassed into the said plots with JCB and damaged the boundary stones.
