Sri P. Gangaiah Naidu, learned Senior Counsel represents Ms. G. Bhanu Priya, learned counsel for the appellant; Sri K. Bhaskara Rao, learned counsel for respondent Nos.1 and 2 and Sri Muralidhar Reddy Katram, learned Government Pleader for Revenue, for respondent Nos.3 to 6.
2. With the consent, finally heard.
3. During the course of hearing, learned counsel for the parties reached to a consensus. It is agreed that since learned Single Judge has not dealt with the merits of the cases despite the fact that the pleadings were complete, impugned common order dated 01.04.2025 directing the appellant to approach the Civil Court may be set aside and the learned Single Judge may be requested to decide the matter on its own merits.
4. In view of consensus arrived at, the impugned common order dated 01.04.2025 is set aside W.P.Nos.34314 and 35740 of 2022 are restored to their original number. This Bench has no doubt that learned Single Judge will make endeavour to decide both the writ petitions on merits. Registry shall list the said writ petitions before the appropriate Bench in the next month.
