ORDER

This Contempt Case is filed alleging willful and deliberate disobedience of the directions of this Court in W.P.No.6762 of

2021, dated 23.07.2024.

2. This Court, vide order dated 23.07.2024 had directed the respondents to consider the experience certificate submitted by the petitioner along with online application only and if the petitioner falls within the zone of consideration, then to consider her case for appointment provided there is a vacancy. The respondents were directed to pass appropriate orders, within a period of three months from the date of receipt of a copy of the order.

It is submitted that the petitioner accordingly made a representation to consider her case in accordance with the above direction and the respondents have passed the orders dated 31.08.2024, rejecting the representation of the petitioner by observing that the notification for the post of Principal (Schools) was closed and that all the filled and unfilled vacancies except four withheld vacancies were handed over to the Unit Officer vide letter No.500/Principal (Schools).REIS/2016, dated 04.06.2024 and that there is no vacancy pending with TGPSC and that there is a separate board by name Telangana Residential Educational Institutions Recruitment Board (TREI-RB), which has been constituted to take up recruitment to new vacancies in Residential Education Institution Societies and as per G.O.Ms.No.81 and G.O.Ms.No.544, the unfilled and non-joining vacancies were carried forward to the next recruitment and TGPSC does not maintain any waiting list.

Learned counsel for the petitioner submitted that while considering the application of the petitioner, the respondents have rejected the case of the petitioner on the same ground which was considered earlier, which was set aside by this Court and was directed to reconsider and thus, there is a deliberate disobedience of the orders of this Court.

5. Learned Standing Counsel for respondent No.1 has filed a counter affidavit supporting the rejection order dated

31.08.2024.

Having regard to the rival contentions and the material on record, this Court finds that the order of this Court was dated 23.07.2024, while the vacancies have already been surrendered by the respondent TGPSC on 04.06.2024 i.e., prior to the order of this Court. Therefore, the TGPSC cannot be said to have committed any Contempt of Court orders. This Court further finds that the direction in the writ petition was to all the respondents in the writ petition, which included the Telangana Residential Educational Institutional Society i.e., respondent No.5. Therefore, the respondent No.5 ought to have directed the new body i.e., the Telangana Residential Educational Institutions Recruitment Board (TREI-RB), to consider the case of the petitioner for the post of Principal (Schools) in accordance with the directions of this Court. However, the order dated 31.08.2024 is passed by the respondent No.1contemnor. The Contempt Case is therefore closed against all the respondents and the respondent No.5 is directed to direct the Telangana Residential Educational Institutions Recruitment Board (TREI-RB), to consider the case of the petitioner in the existing vacancy as per the directions of this Court. The respondent No.5 shall take appropriate steps for consideration.

7. With above directions, the Contempt Case is closed.

There shall be no order as to costs.

8. Miscellaneous applications, if any pending, shall also stand closed.
