THE HON’BLE SRI JUSTICE C.V.BHASKAR REDDY

ORDER:

This writ petition is filed seeking following relief:

“It is therefore prayed that this Hon’ble Court may be pleased to issue an appropriate Writ, order/orders or direction more particularly one in nature of WRIT OF MANDAMUS by declaring the action of the 5^th & 6^th respondents herein in not considering the F-line application vide Application No. DER022300962382 dated: 07- 01-2023 and Application No. AOD022200048009, dated: 10-04-2022 respectively for conducting survey and demarcation of the land to an extent of Ac: 03.30 Gts., in Sy. No. 473/3, situated at Tallapally Village, Shabad Mandal, Chevella Division, Ranga Reddy District as arbitrary illegal and violative of Art. 14, 21 and 300-A of the Constitution of India and besides violative of Principles of Natural Justice and consequently direct the 5^th & 6^th respondents herein to conduct survey and demarcate by fixing boundary stones in respect of petitioner’s land to an extent of Ac: 03.30 Gts., in Sy. No. 473/3, situated at Tallapally Village, Shabad Mandal, Chevella Division, Ranga Reddy District in pursuance of the F-line application vide Application No. DER022300962382 dated: 07-01-2023 and Application No. AOD022200048009, dated: 10-04-2022 submitted by the petitioner and pass such other order or orders as this Hon’ble Court may deem fit and proper in the circumstance of the case and in the interest of Justice.”

It is stated that the petitioner is the absolute owner and possessor of agricultural land admeasuring Acs. 03.30 guntas in Survey No.473/3, situated at Tallapally Village, Shabad Mandal, Chevella Division, Ranga Reddy District (for short, ‘the subject land’). It is further stated that the name of the petitioner was reflected in all the revenue records as pattadar and the revenue authorities also issued e-pattadar pass book bearing No.T05220040335 vide Khata No.615 under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 2020. It is further stated that the petitioner submitted an F-Line application No.

AOD022200048009 dated 10.04.2022 to the 6^th respondent by paying requisite fee to conduct survey of the subject land and fix the boundaries. It is further stated that since the 6th respondent has not taken any action, the petitioner subsequently submitted an F-Line application No. DER022300962382 dated 07.01.2023 to the 5^th respondent by paying requisite fee vide Transaction ID No.TTDER022300962382 to conduct survey of the subject land and fix the boundaries. The grievance of the petitioner is that even after receiving the said F-Line applications, respondent Nos.5 and

6 are not conducting survey and fixation of the boundaries.

3. Considered the submissions of the learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for the respondents and with their consent, this writ petition is disposed of at the admission stage.

Learned counsel for the petitioner has submitted that in terms of the circulars issued by the Commissioner, Survey, Settlements and Land Records, the respondents are bound to consider the application within 45 days from the date of the application after collecting necessary charges. 5. Sri L.Ravinder, learned Assistant Government Pleader for Revenue appearing for the respondents has submitted that the respondent authorities will consider the aforesaid F-Line application submitted by the petitioner by following due procedure laid down under law and conduct survey and demarcate the subject land by fixing boundaries.

It is settled law that the Survey Department has the authority to conduct survey and demarcate lands in accordance with the provisions of the Telangana Land Revenue Act, 1317 Fasli (Act No. VIII of 1317 Fasli), the Telangana Survey and Boundaries Act, 1923, and the Rules framed thereunder. The Government has issued various circulars specifying the conditions for conducting surveys, particularly F-Line (field measurement) survey
