THE HON’BLE SMT. JUSTICE K.SUJANA WRIT PETITION No.15363 of 2025

O R D E R:

1. This Writ Petition is filed by the petitioner declaring the action of 2nd respondent in not allowing the petitioner to appear for Final MBBS Part II (New Regulations) Supplementary examinations to be held from

04.06.2025 to 18.06.2025.

2. Heard learned counsel for the petitioner as well as Ms.Swapna Madhu, learned Assistant Government Pleader representing respondent No.1.

3. Learned counsel for the petitioner would submit that the petitioner has cleared three subjects in Final MBBS Part-I examination and was declared failed in one subject i.e., ‘Community Medicine’. As against the said result, the petitioner had submitted a representation before the concerned Authority, but till today, the concerned Authority has not disposed of his representation and not allowing the petitioner to write the examinations of Final MBBS Part II examinations.

4. Learned counsel further submits that as per the Statement of Marks issued by the 2nd respondent-University, the petitioner had already cleared Paper-I and Paper –II in 3 subjects, but in ‘Community Medicine’ subject, he was declared to be failed and according to the petitioner, there is no proper evaluation of paper and for some questions, he was awarded only one mark and for one question, they have not even evaluated. As such, he made a representation to the 2nd respondent-University through e-mail on 07.05.2025.

5. Learned Standing Counsel for 2nd respondent-University would submit that there is no error in the evaluation. The only error that has been crept in the said statement of marks issued by them is instead of mentioning for 100 marks, it is mentioned as 80 marks and that they will dispose of the representation submitted by the petitioner by tomorrow itself and communicate the same to the petitioner.

6. Having considered the submissions made by both parties, this Writ Petition is disposed of directing the 2nd respondent-University to dispose of the representation submitted by the petitioner through e-mail on 07.05.2025 and serve copy of the same by tomorrow itself. There shall be no order as to costs.

7. Miscellaneous applications pending, if any, shall stand closed.
