ORDER:
This writ petition is filed seeking the following prayer:-

to issue a writ order or direction particularly one in the nature of Writ of Mandamus delcaring the action of the 2nd respondent in not considering the representation dated 5.5.2025 of the petitioner which was acknowledged by the office of the 2nd respondent on 5.5.2025 before grant of construction permission vide application No 03237/BP/HMDA/0961/MED in favour of the respondents 3 and 4 in respect of land in Sy No 295 admeasuring Ac 400 situated at Mallampet village Dundigal Gandimaisamma Mandal MedchalMalkajgiri district as there is a boundary dispute as to location of the land in Sy No 295 admeasuring Ac 400 guntas situated at Mallampet village Dundigal Gandimaisamma Mandal MedchalMalkajgiri district and the land in Sy No 297 admeasuring Ac 316 gts and Sy No 81/2 admeasuring Ac 025 guntas situated at Bollaram village Jinnaram Mandal Sanga Reddy District the Survey for location of the both the Survey Numbers are pending under consideration before the Assistant Director of Survey and Land Records Sanga Reddy as the same is illegal arbitrary and violation of Article 300A of the Constitution of India and consequently direct the 2nd respondent to withhold grant of permission in favour of the respondents 3 and 4 in respect of land in Sy No 295 admeasuring Ac 400 gts situated at Mallampet village Dundigal Gandimaisamma Mandal Medchal Malkajgiri district till the survey is conducted for the …”

2. Heard Mr.A.Prabhakar Rao, learned counsel for the petitioners, Mr.V.Narsimha Goud, learned Standing Counsel for respondent No.2 and learned Assistant Government Pleader for respondent No.5.

Learned counsel for the petitioners submits that respondent No.4 applied for building permission vide application No.003237/BP/HMDA/0961/MED/2025, before 2nd respondent, against which the petitioners have filed their objection/representation, dated 05.05.2025, stating that the subject land is a disputed land and requested not to grant any kind of permission till the disposal of the said objection/representation. The grievance of the petitioners is that even after receiving and acknowledging the said objection/representation, the 2nd respondent has not acted upon the same. Therefore, the present writ petition.

In view of the above, this Court, without going into the merits of the case, deems it appropriate to direct the 2nd respondent to consider the objection/representation, dated 05.05.2025, after giving opportunity of personal hearing to all the parties, and pass appropriate orders, in accordance with law, within a period of four (04) weeks from the date of receipt of copy of this order.
Miscellaneous applications, if any, pending in this writ petition, shall stand closed.
