ORDER:

This Criminal Petition is filed under Sections 480 and

483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, ‘BNSS’) by the petitioner-accused No.4, seeking bail in Crime No.438 of 2024 of Kachiguda Police Station, Hyderabad, registered for the offences punishable under Section 8(c) read with Sections 20(b)(ii)(C) and 29 of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, ‘the Act’).

2. Heard learned counsel for the petitioner-accused No.4 and learned Additional Public Prosecutor appearing for the respondent-State. Perused the material available on record.

3. This is the second bail petition filed by the petitioner. As the earlier bail petitions i.e., Crl.P.Nos.1001, 3331 & 5617 of 2025 filed by the petitioner herein along with accused Nos.5, 6 and 7 have already been dismissed by this Court, as the petitioner was involved in transportation of 119.6 Kgs of Ganja with other accused. Since the Ganja which was seized from the possession of the accused is commercial quantity and as the petitioner has not satisfied the Twin conditions of Section 37 of the NDPS Act, which mandates that offences involving commercial quantities are non-bailable, unless there
