The case of the prosecution is that on 09.09.2024 in the outskirts of Chiragpally village, the Police found A-1 and A-2 transporting 140 kgs dry ganja illegally from Malkangiri of Odisha State to Balki of Karnataka State. Learned Additional Public Prosecutor on instructions submits that the petitioner herein is involved in similar offences of NDPS Act and opposed the bail petition stating that the petitioner is involved in a grave offence of transporting dry ganja weighing 140 kgs along with other accused, which is a commercial quantity and the investigation is under progress and at this stage, the petitioner is not entitled for grant of bail.

6. The petitioner being involved in similar offences and considering the quantity of ganja that has been seized and in view of the provisions under Section 37 of NDPS Act where the twin conditions have to complied with and since the petitioner has not placed any material to show that the said conditions were complied with for granting bail, this Court is not inclined to grant bail to the petitioner.
