ORDER:

Heard Sri G. Arun Kumar, learned counsel appearing on behalf of the petitioner and the learned Government Pleader for Energy appearing on behalf of the respondent No.1 and Sri N. Sreedhar Reddy, learned Standing Counsel for TGSSPDCL appearing on behalf of the respondent Nos.2 to 5.

2. The petitioner approached the Court seeking prayer as under:

“….Hon'ble Court may be pleased to issue an appropriate writ or order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the respondent Nos. 3 to 5 in disconnecting the Electricity Service connection No. 114592356 to the petitioner servant room situated at House plot land admeasuring 250 Sq.yards equivalent to 209 Sq.Meter out of 1500 Sq.yards situated at Serilingampally village in Sy.No. 88/1 Serilingampally Mandal, Under GHMC Serilingampally Circle, Medchal- Malkajgiri district Telangnaa State without issuing notice and opportunity as is illegal, arbitrary, contrary to law and violation ofprincipesl of Natural Justice besides in violation of the Electricity act, 2003 and rules made there under and also violation of Article, 14, 300A of the Constitution of India and consequently direct the respondents to restore the Power supply to the Petitioner servant room as mentioned above and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.…”

3. The case of the petitioner in brief as per the averments made by the petitioner in the affidavit filed by the petitioner in support of the present Writ Petition is as under:-

The petitioner is the owner and possessor of the house plot land admeasuring 250 sq.yard equivalent to 209 sq.meter out of 1500 sq.yards situated at Serilingampally Village in Sy.No.88/1, Serilingampally Mandal, under GHMC Serilingampally circle, Rangareddy District, presently Medchal- Malkajgiri District, Telangana state having acquired the same through a registered Gift Settlement Deed, vide document No.163/2021, dated 05.01.2021.

It is further the case of the petitioner that since 2021 the petitioner had been enjoying the said subject property as a lawful owner and possessor and the said property has one room meant for Watchmen. The petitioner applied for a domestic electricity service connection for the servant room on 27.01.2024, and also paid the required charges of Rs. 38,447/-

and was granted Service No.114592356, dated 10.02.2024 at Tara Nagar as per the Assistant Engineer work order and thereafter, electricity was supplied without interruption, and bills were paid regularly. However, on 21.04.2025, without any notice or opportunity to the petitioner, the electricity service was disconnected by officials, allegedly in violation of the Electricity Act, 2003 and in clear violation of principles of natural justice. A representation, dated 23.04.2025 was submitted by the petitioner to the respondent Nos.3& 4 requesting restoration, but no action had been taken as on date. Aggrieved by the same, the petitioner filed the present writ petition.

The learned counsel appearing on behalf of the petitioner submits that the limited relief that the petitioner seeks in the present Writ Petition is a direction to the respondent Nos.3 to 5 to restore the power supply vide Service Connection No.114592356 of the petitioner’s servant room situated at house plot land admeasuring 250 sq.yards equivalent to 209 sq.meter out of 1500 sq.yards situated at Serilingampally Village in Sy.No.88/1, Serilingampally Mandal under GHMC Serilingampally circle, Medhcal Malkajgiri District duly considering petitioner’s representation, dated 23.04.2025 addressed to the respondent Nos.3 & 4.

5. Learned counsel appearing on behalf of the petitioner submits that the Writ Petition could be disposed of directing the respondent Nos.3 to 5 to consider the grievance of the petitioner as put-forth vide
