THE HONOURABLE SRI JUSTICE J. SREENIVAS RAO CRIMINAL PETITION No.6356 of 2025

ORDER:

This Criminal Petition is filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) by the petitioners/A1 and A2 seeking regular bail in Crime No.65 of 2025 of Koheer Police Station, Sangareddy District, registered for the offences punishable under Sections 109, 118(1) read with

3(5) of Bharatiya Nyaya Sanhita, 2023 (BNS).

The case of prosecution in brief is that on 10.04.2025 at 18.00 hours, the complainant lodged a complaint, wherein it is stated that when there is was threat to his life by Akbar Hussain, Anwar Hussain, Asgar Hussain, Nusrath Begum, residents of Koheer Village, he filed many complaints. It is further stated that Crime No.62 of 2025 was registered against accused Nos.1 and 2 in respect of land in Sy.No.38/E/1. When he, along with his mother and his car driver, were having lunch at his mango farm in Sy.No.38/E/1 of Khanapur Village of Koheer Mandal, the accused persons came with sticks and intentionally tried to kill him and his mother and beat him with stick on his head and also beat his mother on her head and legs due to which they received severe bleeding injuries and were shifted to hospital.

Basing on the said complaint, the present crime was registered.

3. Heard Mr. P. Srihari Nath, learned counsel for the petitioners, and Mr. D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent - State.

4. Learned counsel for the petitioners submitted that the petitioners have not committed the offence and they were falsely implicated in the present crime. Even according to the allegations made in the complaint, property disputes are pending between the petitioners and the de facto complainant and to dissolve the said disputes, the petitioners were falsely implicated. Therefore, the ingredients of Sections 109 and 118 of the BNS do not attract against the petitioners. The petitioners were arrested on 11.04.2025 and since then they were in judicial custody. The entire investigation is completed except filing of charge sheet. He further submitted that petitioner No.2 is 62 years aged person and suffering with old age ailments and that the petitioners are not having any criminal antecedents. The petitioners are ready and willing to cooperate with the investigation and also abide by the conditions, which are going to be imposed by this Court.

Hence, the petitioners prayed to grant bail.

5. Per contra, learned Additional Public Prosecutor submitted that the petitioners have committed a grave offence and the investigation is under progress. At this stage, if the petitioners are enlarged on bail, they will interfere with the investigation and also influence the witnesses. There are specific allegations levelled against the petitioners to attract the ingredients of Sections 109 and 118 of BNS.

6. Having considered the rival submissions made by both the parties and after perusal of the material available on record, it reveals that there are specific allegations against petitioners. Taking into consideration the facts and circumstances of the case and the gravity of the offence, this Court is not inclined to grant bail in favour of petitioners, especially when the investigation is under progress.

7. Accordingly, the criminal petition is dismissed.

Miscellaneous applications, pending if any, shall stand closed.
