JUDGMENT:

This appeal is filed against the Order dated 31.03.2008 in O.P.No.705 of 2006 passed by the Chairman, Motor Accidents Claims Tribunal-cum-I Additional District Judge, Karimnagar.

2. The appellants/petitioners filed O.P.No.705 of 2006, claiming compensation on account of injuries sustained by the petitioner No.1 in the road traffic accident occurred on 30.03.2006. The Police, Miyapur, Cyberabad registered a case in Crime No.139 of 2006.

3. Learned counsel for appellants/petitioners stated that on behalf of the petitioners, P.Ws.1 to 3 were examined and Exs.A1 to A59 were marked. Ex.B1 was marked on behalf of respondents.

4. The Trial Court considering the oral and documentary evidence granted Rs.5,58,000/- with interest @ 7.5% per annum from the date of petition to till the date of deposit. Challenging the quantum of compensation as meagre, the petitioners have filed the present appeal.

5. Learned counsel for the petitioners mainly contended the tribunal erred in fixing the 25% contributory negligence to the petitioners/appellants herein only on presumptions and surmises which is impermissible under the law. Pet
