THE HON’BLE SRI JUSTICE J. SREENIVAS RAO CRIMINAL PETITION No.5940 of 2025

ORDER:

This criminal petition is filed by the petitioner/A19 under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) seeking regular bail in Crime No.180 of 2025 on the file of Chaitanyapuri Police Station, Rachakonda Commissionerate, registered for the offence punishable under Section 143(5) read with Section 3(5) of Bharatiya Nyaya Sanhita and Sections 80, 81 and 87 of the Juvenile Justice (Care and Protection of Children) Act, 2015 and Section 88 of the Juvenile Justice (Care and Protection of Children) Act, 2000.

The case of the prosecution is that on 25.02.2025 at 0930 hours, on receipt of credible information about illegal sale of child by some persons near Prabhath Nagar Colony Park gate, Prabhath Nagar, Uppal, Medchal-Malkajgiri District, the Sub-Inspector of Police, Chaitanyapuri Police Station, along with two mediators visited the said place and found three persons under suspicious circumstances and took them into custody. On interrogation, one of the persons revealed her name as Kola Krishnaveni, working as Medical Representative and confessed that all the persons are at Deepthi house and they used to sell the children for money and share the same among themselves. After recording the confessional statements of Krishnaveni, Savitri and Sampath Kumar, the possession of the child was taken and registered the above crime.

3. Heard Sri P. Vikasraj, learned counsel for the petitioner, and Sri Syed Yasar Mamoon, learned Additional Public Prosecutor for the respondent.

4. Learned counsel for the petitioner submits that the petitioner has not committed the offence and she was falsely implicated in the present crime. The petitioner/accused No.19 was arrested on 19.03.2025 and since then she was in judicial custody. The entire investigation is completed except filing of the charge sheet. The petitioner is ready and willing to cooperate with the investigation and also abide by the conditions that are going to be imposed by this Court.

Per contra, learned Additional Public Prosecutor submits that the petitioner has committed grave offence of trafficking of children for her peculiar benefits and she used to procure the children and sell them to various persons. The investigation is under progress and charge sheet has not been filed. At this stage, if the petitioner is enlarged on bail, she will interfere with the investigation and also influence the witnesses. Therefore, the petitioner is not entitled for grant of bail.

Having considered the rival submissions made by both the parties and after perusal of the material available on record, it reveals that specific allegations are levelled against the petitioner that she was involved in trafficking of children for her peculiar benefits and procured the children and sold them to various persons. Even according to the learned Additional Public Prosecutor, the investigation is under progress.

7. Taking into consideration the facts and circumstances of the case and the gravity of offence, this court is not inclined to grant bail to the petitioner at this stage especially when the investigation is under progress.

8. Accordingly, the criminal petition is dismissed.

Pending miscellaneous applications, if any, shall stand closed.
