HON’BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.33900 of 2024

O R D E R

None appears for the petitioner.

2. Heard learned Government Pleader for Home appearing on behalf of respondent Nos.1 & 2 and Ms.Vanaparthi Vaishali, learned counsel appearing on behalf of respondent No.3, and perused the record.

The case of the petitioner as set out in the Writ Affidavit in brief is that, a Look Out Circular (LOC) has been opened against him in connection with Cr.No.60/2022 (C.C.No.239/2023), wherein the 2^nd respondent sent an e.mail dated 25-11-2024 to petitioner’s employer at United States of America calling for particulars of petitioner for the purpose of investigation process, which action it is contended as illegal, arbitrary, capricious, mala fide and contrary to Section 10 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and also contrary to Circular issued by Government of India dated 11-02-2009. 4. Learned Government Pleader for Home appearing on behalf of respondent Nos.1 and 2 would submit that this Court by order dated 10-12-2024, taking note of the fact that the Non-Bailable Warrants issued against the petitioner have been recalled, the LOC, if any issued against the petitioner in connection C.C.No.239 of 2023 on the file of trial Court shall stand suspended for a period of two months, and that the petitioner was directed to comply with the conditions imposed by the trial Court in the order dated 25-11-2024 passed in Crl.M.P.No.632 of 2024 in C.C.No.239 of 2023.

5. It is further contended by the learned Government Pleader for Home that this Court while directing as above, observed that on petitioner surrendering before the trial Court, further conditions, as may be appropriate, be imposed by the trial Court.

It is contended by the learned Government Pleader that in the aforesaid order, this Court further observed that, if the petitioner intends to travel to any foreign country, he is at liberty to file application before the trial Court seeking permission, and that if such permission is granted, the LOC opened against the petitioner shall be suspended by the trial Court from time to time for the corresponding period.

7. Learned Government Pleader would further submit that pursuant to the aforesaid liberty granted by this Court, the petitioner had travelled abroad by complying with the conditions imposed by the trial Court.

8. Learned Government Pleader would also submit that, since the petitioner is complying with the conditions imposed by the trial Court, the 2^nd respondent had addressed a letter dated 30-04-2025 to the Superintendent of Police seeking for revocation of the LOC.

9. Learned Government Pleader further submits that on receiving necessary approval from the Commissioner, the authorities would address a communication to the concerned Immigration Authorities to revoke the LOC opened against the petitioner.

10. The aforesaid submission made by the learned Government Pleader for Home is taken on record.

Having regard to the submissions made as above, and taking note of the fact that this Court by order dated 10-12-2024 having permitted the petitioner to travel to any foreign country by obtaining permission from the trial Court by complying with the conditions imposed by the trial Court, and also taking note of the submissions made by the learned Government Pleader for Home that the authorities having addressed a letter dated 30-04-2025 seeking permission to revoke the LOC opened against the petitioner, this Court is of the view that the respondent authorities on obtaining permission from the 2^nd respondent, are to be directed to address letter to the Immigration Authorities, in the event, they wish to revoke the LOC opened against the petitioner. If the respondent authorities take a decision not to revoke the LOC, the petitioner is at liberty to obtain permission from the trial Court to travel to foreign country by complying with the conditions imposed by the trial Court in terms of order of this Court dated 10-
