O R D E R

Heard learned counsel for the petitioner appearing through Virtual Mode, learned Government Pleader for Home appearing for respondent Nos.1 to 5, and with their consent the Writ Petition is taken up for hearing and disposal at admission stage.

2. Having regard to the manner of disposal of the writ petition and the nature of lis involved, this Court is of the view that notice to unofficial respondent Nos.6 & 7 is not necessary for adjudication of the present Writ Petition.

The case of the petitioner, in brief, is that though he had approached the respondents-authorities by submitting a representation, dt.12.03.2025, by sending the same through registered post on 13.03.2025, no action has been taken by the authorities by registering the FIR against the persons named in the said representation, which action of the respondents-authorities it is contended as highly illegal and arbitrary.

Per contra, learned Government Pleader appearing on behalf of official respondents submits that the petitioner had approached this Court on earlier occasion vide WP.No.8504 of 2025 by making municipal authorities as well as police authorities as party respondents seeking multiple reliefs therein, and on this Court not inclined to grant any relief, the petitioner had withdrawn the said Writ Petition with liberty to avail remedies open to him in law.

Learned Government Pleader further submits that the petitioner having withdrawn the said writ petition to avail remedies open to him in law, has filed the present Writ Petition, once-again, seeking relief only against the action of the respondents-police authorities in not registering the FIR based on his representation/complaint, dt.12.03.2025.

6. Learned Government Pleader further submits that this Court having taken a consistent view that for non-registration of FIR, the party has to avail further remedies provided under BNSS, the present Writ Petition cannot be maintained.

7. I have taken note of the respective submissions made.

A perusal of the cause title and the relief sought for in the earlier writ Petition filed by the petitioner vide WP.No.8504 of 2025, would indicate that the petitioner had questioned the inaction of respondents No.2 to 5 on his representation, dt.12.03.2025 with a consequential relief to direct the municipal respondents not to grant permission in favour of the unofficial respondents. The further relief sought for by the petitioner in the said writ petition is for issuing a direction to the 9^th respondent i.e., SHO., Film Nagar Police Station, Film Nagar, Hyderabad, to register the FIR basing on the complaint, dt.12.03.2024 of the petitioner against respondent Nos.10 & 11 therein.

Since, the petitioner has already approached this Court on earlier occasion seeking a direction for registration of FIR based on his complaint/representation, dt.12.03.2025, and having withdrawn the said writ petition with liberty to avail further remedies, cannot approach this Court once-again by filing a Writ Petition seeking same relief against the SHO., Film Nagar Police Station, Film Nagar, Hyderabad, who is arrayed as 5th respondent herein, by excluding the municipal authorities from the array of parties in the present petition.

10. The said procedure adopted by the petitioner is clearly an abuse of process of law and needs to be deprecated.

11. Accordingly, the Writ Petition is dismissed with exemplary costs of Rs.10,000/- (Rupees Ten thousand only) payable to the Telangana High Court Advocates Library, within a period of four (04) weeks from the date of receipt of copy of the order.

12. Consequently, miscellaneous petitions, if any, pending shall stand closed.
